  4. 1.   The Schedule of a Party sets out the reservations taken by
  5. that Party, pursuant to Articles 1108(4) and 1206(4), with respect
  6. to specific sectors, sub-sectors or activities for which it may
  7. maintain existing, non-conforming measures or adopt new or more
  8. restrictive measures.  Such measures may derogate from an
  9. obligation relating to:
  10.  
  11.      (a) national treatment, pursuant to Article 1102 (Investment)
  12.  or 1202 (Services);
  13.  
  14.      (b) most-favored-nation treatment, pursuant to Article 1103
  15.  (Investment) or 1203 (Services); 
  16.  
  17.      (c) local presence, pursuant to Article 1205 (Services);
  18.  
  19.      (d) performance requirements, pursuant to Article 1106
  20.  (Investment); or
  21.  
  22.      (e) nationality requirements for senior management or members
  23.  of boards of directors, pursuant to Article 1107
  24.  (Investment).

  26. 2.   Each reservation sets out the following elements:
  27.  
  28.      (a) SECTOR refers to the general sector in which the
  29.  reservation is taken;
  30.  
  31.      (b) SUB-SECTOR refers to the specific sector in which the
  32.  reservation is taken;
  33.  
  34.      (c) INDUSTRY CLASSIFICATION refers to the activity, where
  35.  appropriate, covered by the reservation according to
  36.  domestic industry classification codes;
  37.  
  38.      (d) TYPE OF RESERVATION specifies the obligation referred to
  39.  in paragraph 1 for which a reservation is taken;
  40.  
  41.      (e) DESCRIPTION describes the scope of the sector, sub-sector
  42.  or activities covered by the reservation; and
  43.  
  44.      (f) LEGAL CITATION OF EXISTING MEASURES identifies existing
  45.  measures that apply to the sector, sub-sector or
  46.  activities covered by the reservation.

  48. 3.   In the interpretation of a reservation, all elements of the
  49. reservation should be considered.  In the event of any
  50. inconsistency between DESCRIPTION and any other element of the
  51. reservation, the DESCRIPTION shall govern to the extent of the
  52. inconsistency.

  54. 4.   For purposes of this Annex:
  55.  
  56. CMAP means Clasificación Mexicana de Actividades y Productos;
  57.  
  58. CPC means Central Product Classification numbers as set out in
  59. Statistical Office of the United Nations, Statistical Papers,
  60. Series M, No. 77,  Provisional Central Product Classification,
  61. 1991;
  62.  
  63. Mexican enterprise means an enterprise constituted under the laws
  64. of Mexico;
  65.  
  66. Mexican national means a national of Mexico, as defined by the
  67. Constitution of Mexico;
  68.  
  69. person of a Party means a national or an enterprise of a Party; and
  70.  
  71. SIC means:
  72.  
  73.      (a) with respect to Canada, Standard Industrial
  74.  Classification (SIC) numbers as set out in Statistics
  75.  Canada, Standard Industrial Classification, fourth
  76.  edition, 1980; and
  77.  
  78.      (b) with respect to the United States, Standard Industrial
  79.  Classification (SIC) numbers as set out in the United
  80.  States Office of Management and Budget, Standard
  81.  Industrial Classification Manual, 1987.
