  1.                     LIMITED WARRANTY
  2.  
  3. 1.  Governing Law.  This limited warranty and the license agreement
  4. shall be construed, interpreted and governed by the laws of the
  5. State of Utah and any action hereunder shall be brought only in
  6. Utah. If any provision is found void, invalid or unenforceable it
  7. will not affect the validity of the balance of this Limited
  8. Warranty and the License Agreement which shall remain valid and
  9. enforceable according to its terms.

  11. 2.  What is Covered By The Warranties.  Knowledge Software Systems,
  12. L.C. (K.S.S.) warrants that the magnetic media which the Software
  13. is recorded on and the documentation provided with it are free from
  14. defects in materials and workmanship under normal use.  K.S.S.
  15. warrants that the software itself will perform substantially in
  16. accordance with the specifications set forth in this document.

  18. 3.   Duration Of The Warranties.  The above express warranties are
  19. made for the period of 90 days from the date the Software is
  20. delivered to you as the first user.
  21.  
  22. 4.  Replacement.  Your re-seller will either replace any magnetic
  23. media which proves defective in materials or workmanship without
  24. additional charge on an exchange basis.
  25.  
  26. 5.  Correction of Software.  Your re-seller will either replace or
  27. repair without additional charge any software that does not perform
  28. in substantial accordance with the specifications set forth in this
  29. document.  This will be done by delivering to you a corrected copy
  30. of the software on an exchange basis.

  32. 6.  Final Remedy.  If your re-seller is unable to replace defective
  33. documentation or defective media within a reasonable time, your
  34. re-seller will refund the license fees paid for the use of the
  35. software.

  37. 7.  ANY IMPLIED WARRANTIES INCLUDING ANY WARRANTIES OF
  38. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO
  39. THE TERM OF THE EXPRESS WARRANTIES.

  41. 8.  K.S.S. SHALL NOT IN ANY CASE BE LIABLE FOR SPECIAL, INCIDENTAL,
  42. CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM ANY
  43. BREACH OF THESE WARRANTIES EVEN IF K.S.S. OR ITS AGENT HAS BEEN
  44. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  46. 9.  Other Conditions.  The warranties set forth above are in lieu
  47. of all other express and implied warranties, whether oral, written
  48. or implied, and the remedies set forth above are your sole and
  49. exclusive remedies.
