  1.                             LIMITED WARRANTY
  2.  
  3. 1.  Governing Law.  This limited warranty and the license agreement shall be
  4. construed, interpreted and governed by the laws of the State of Utah and any
  5. action hereunder shall be brought only in Utah. If any provision is found
  6. void, invalid or unenforceable it will not affect the validity of the balance
  7. of this Limited Warranty and the License Agreement which shall remain valid
  8. and enforceable according to its terms.

  10. 2.  What is Covered By The Warranties.  Knowledge Software Systems, L.C.
  11. (K.S.S.) warrants that the magnetic media which the Software is recorded on
  12. and the documentation provided with it are free from defects in materials and
  13. workmanship under normal use.  K.S.S. warrants that the software itself will
  14. perform substantially in accordance with the specifications set forth in this
  15. document.

  17. 3.   Duration Of The Warranties.  The above express warranties are made for
  18. the period of 90 days from the date the Software is delivered to you as the
  19. first user.

  21. 4.  Replacement.  Your re-seller will either replace any magnetic media which
  22. proves defective in materials or workmanship without additional charge on an
  23. exchange basis.
  24.  
  25. 5.  Correction Of Software.  Your re-seller will either replace or repair
  26. without additional charge any software that does not perform in substantial
  27. accordance with the specifications set forth in this document.  This will be
  28. done by delivering to you a corrected copy of the software on an exchange
  29. basis.

  31. 6.  Final Remedy.  If your re-seller is unable to replace defective
  32. documentation or defective media within a reasonable time, your re-seller
  33. will refund the license fees paid for the use of the software.

  35. 7.  ANY IMPLIED WARRANTIES INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR
  36. FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE TERM OF THE EXPRESS
  37. WARRANTIES.

  39. 8.  K.S.S. SHALL NOT IN ANY CASE BE LIABLE FOR SPECIAL, INCIDENTAL,
  40. CONSEQUENTIAL, INDIRECT OR OTHER SIMILAR DAMAGES ARISING FROM ANY BREACH OF
  41. THESE WARRANTIES EVEN IF K.S.S. OR ITS AGENT HAS BEEN ADVISED OF THE
  42. POSSIBILITY OF SUCH DAMAGES.

  44. 9.  Other Conditions.  The warranties set forth above are in lieu of all
  45. other express and implied warranties, whether oral, written or implied, and
  46. the remedies set forth above are your sole and exclusive remedies.
