  146. l. Use Restrictions: This product a) may be used only by the purchasing End-user and may not be made available for any 
  147. other use by any loan rental, service bureau, or other arrangement: b} may only be used for reference purposes; use lor com┬¼ 
  148. mercial direct mail or telemarketing of more than 100 listings per month is strictly prohibited; c) may be used only in conjunction 
  149. with a single microcomputer permitting access by one individual user at one time; and d) may nol be made available to multiple 
  150. users al one time through networking or any other means without obtaining a separate network license from DDA.

  152. 2 Proprietary Rights- End-user acknowledges that the Databases are proprietary to DDA. or its suppliers, that they shall 
  153. remain the exclusive property of DDA, or its suppliers, and that End-user shall have no rights therein other than as set forth 
  154. herein, The Databases or information contained therein may nol be sold, duplicated, transferred or in any other manner com┬¼ 
  155. mercially exploited 1 End-user agrees to take reasonable measures to ensure lhat such unauthorized use is not achieved,

  157. 3 Proprietary Rights In and Responsibility lor Software: End-user acknowledges that the compacl discs contain search and 
  158. retrieval software thal DDA is hereby sublicensing to End-user on a non- exclusive basis lor the limited purpose of manipulating 
  159. the data contained on Ihe compacl discs. End-user acknowledges that such Software comprises valuable proprietary and confi┬¼ 
  160. dential information which is legally protected under trade secret and copyright laws. End-user is not authorized to reverse com┬¼ 
  161. pile or reverse assemble the Software or otherwise attempt to reveal the proprietary programming techniques and structures 
  162. used in the Software. The end-user is not authorized to duplicate, transfer, sell, or in any commercial manner, explort the 
  163. Software.

  166. 4 Disclaimer of Warranty and Limited Warranty/Final Expression of Agreement: THE COMPACT DISCS. DATABASES, AND 
  167. SOFTWARE ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND INCLUDING BUT NOT LIMITED TO ANY

  169. implied warranty of fitness for any particular purpose or warranty of merchantability, dda

  171. DOES NOT WARRANT GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF 
  172. THE USE OF THE MATERIALS IN TERMS OF THE ACCURACY. RELIABILITY, CURRENTNESS, OR OTHERWISE OF 
  173. THEIR CONTENTS OR PRODUCT. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE COMPACT 
  174. DISC IS ASSUMED BY THE END-USER. DDA r S SOLE LIABILITY SHALL BE TO REPLACE THE COMPACT DISC IN THE 
  175. EVENT THE COMPACT DISC ITSELF. AS OPPOSED TO THE SOFTWARE OR DATABASE ENCODED THEREIN, IS

  179. II lailure of the materials has resulted from accident, abuse, or misapplication, DDA shall have no responsibility to replace the

  183. NEITHER DDA NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION. OR DELIVERY OF 
  184. THIS PRODUCT SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES 
  185. riNCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFOR┬¼

  190. Prior to the execution of this Agreement, End-user may have received wrilten or oral statements about the Materials provided 
  191. hereunder. Such statements do nol constitute warranties, shall not be relied on by the End-user, and are not a part of this 
  192. Agreement The entire Agreement between the parties is embodied in this writing.

  194. 5 General' Any cause of action brought by any party against the other based upon the terms of this Agreement shall be 
  195. brought within one year of the accrual of the cause of action, Any question concerning the validity construction, or performance 
  196. of this Agreement shall be governed by the laws of the Stale of Maryland Any questions about this license should be directed
