  138. IMPORTANT; USE OF DDA COMPACT DISCS CONSTITUTES ACCEPTANCE OF 
  139. THE FOLLOWING TERMS AND CONDITIONS.

  141. 1. Use Restrictions; This product a) may be used only by the purchasing End-user and may not be made available for any 
  142. other use by any loan, renlal, service bureau, or other arrangement; b) may only be used tor reference purposes; use for com 
  143. mercial direct mail or telemarketing of more than 100 listings per month is Striclly prohibited; c) may be used only in conjunction 
  144. with a single microcomputer permitting access by one individual user at one time, and d) may not be made available to multiple 
  145. users at one time through networking or any other means without obtaining a separate network license from DDA.

  147. 2 . Proprietary Rights; End-user acknowledges that the Databases are proprietary to DDA, or its suppliers, that they shall 
  148. remain the exclusive property of DDA. or its suppliers, and that End-user shall have no rights therein other than as set forth 
  149. herein. The Databases or information contained therein may not be sold, duplicated, transferred or tn any other manner com┬¼ 
  150. mercially exploited End-user agrees to take reasonable measures to ensure that such unauthorised use is not achieved.

  152. 3. Proprietary Rights In and Responsibility lor Software: End-user acknowledges that the compact discs contain search and 
  153. retrieval software that DDA is hereby sublicensing to End-user on a non exclusive basis for the limited purpose of manipulating 
  154. the data contained on the compact discs. End-user acknowledges that such Software comprises valuable proprietary and confi┬¼ 
  155. dential information which is legally protected under trade secret and copyright laws. End-user is not authorized to reverse com┬¼ 
  156. pile or reverse assemble the Software or otherwise attempt to reveal the proprietary programming techniques and structures 
  157. used m the Software. The end-user is not authorized to duplicate, transfer, sell, or in any commercial manner, exploit the 
  158. Software.

  160. 4 Disclaimer ot Warranty and Limited Warranty/Final Expression of Agreement: THE COMPACT DISCS. DATABASES, AND 
  161. SOFTWARE ARE PROVIDED "AS IS WITHOUT WARRANTY OF ANY KIND INCLUDING BUT NOT LIMITED TO ANY 
  162. IMPLIED WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE OR WARRANTY OF MERCHANTABILITY. DDA 
  163. DOES NOT WARRANT GUARANTEE OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF 
  164. THE USE OF THE MATERIALS IN TERMS OF THE ACCURACY. RELIABILITY. CURRENTNESS. OR OTHERWISE OF 
  165. THEIR CONTENTS OR PRODUCT. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE COMPACT 
  166. DISC IS ASSUMED BY THE END-USER DDA'S SOLE LIABILITY SHALL BE TO REPLACE THE COMPACT DISC IN THE 
  167. EVENT THE COMPACT DISC ITSELF. AS OPPOSED TO THE SOFTWARE OR DATABASE ENCODED THEREIN, IS 
  168. DEFECTIVE

  171. If failure of the materials has resulted from accident. abuse, or misapplication, DDA shall have no responsibility to replace the 
  172. Materials.

  175. NEITHER DDA NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION. OR DELIVERY OF 
  176. T H| S PRODUCT SHALL BE LIABLE FOR ANY DIRECT. INDIRECT. CONSEQUENTIAL OR INCIDENTAL DAMAGES 
  177. (INCLUDING DAMAGES FOR LOSS OF BUSINESS PROFITS. BUSINESS INTERRUPTION. LOSS OF BUSINESS INFOR┬¼ 
  178. MATION AND THE LIKE} ARISING OUT OF THE USE OF OR INABILITY TO USE SUCH PRODUCT EVEN IF DDA HAS 
  179. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  182. Prior to the execution of this Agreement, End-user may have received written or oral statements about the Materials provided 
  183. hereunder. Such statements do not constitute warranties, shall not be relied on by the End-user, and are not a part of this 
  184. Agreement. The entire Agreement between the parties is embodied in this writing.

  186. 5. GeneralΓÇÖ Any cause of action brought by any party against the other based upon the terms ot this Agreement shall be 
  187. brought within one year of the accrual of the cause of action. Any question concerning the validity construction, or performance 
  188. of this Agreement shall be governed by the laws of the State ot Maryland. Any questions about this license should be directed
