  2.    LOS ANGELES (UPI) -- A $10 million civil rights suit was filed
  3. Friday against Los Alamitos police in the death of an armed man who
  4. was shot by officers inside his apartment.
  5.    The family's lawyer, Steve Yagman, said Sylvan Byrd, 40, was shot
  6. by police Jan. 23 after the victim answered a loud banging on the
  7. door to his home.
  8.    Yagman said police went to Byrd's apartment after a report of a
  9. loud noise. The attorney said Byrd and his wife, Ellen, had been
  10. arguing.
  11.    When Sylvan Byrd went to answer the door, his wife said he picked
  12. up a handgun he kept on a shelf in the foyer. Ellen Byrd said police
  13. fired numerous shots when her husband opened the door a few inches
  14. wide.
  15.    It is not clear whether officers saw Sylvan Byrd's weapon. Yagman
  16. said police handcuffed the man they shot even though he died at the
  17. scene. Ellen Byrd also was handcuffed.
  18.    The attorney said witnesses claim the officers did not announce
  19. themselves as police.
  20.    The Los Alamitos police chief did not return telephone calls
  21. regarding the case. Other Los Alamitos city officials, who also were
  22. named in the suit, have retained Santa Ana attorney Bruce Praet to
  23. represent them and the police in the case. Praet could not be
  24. reached for comment Friday.
