  8. You (Southwest  Bell) state "Business  nature is defined  as
  9. being  any provision  of BBS  for which  the BBS operator or
  10. operation  received  or   requests  any  compensation  which
  11. includes  any  form  of   income,  revenue,  payment,  gain,
  12. contribution, donation, gift, or gratuity."

  14. I  counterpropose a  definition of business that  has a much
  15. more specific  and clearly outlined  definition of business.
  16. Here is my definition:

  18. Business nature is defined (for BBSes located in residences)
  19. as  being any  system which  meets any  one or  more of  the
  20. following criteria:
  21.  
  22.      (1) Said system charges  fees or receives contributions
  23. in excess of costs for any  useful access to the system. (2)
  24. Said system solicits customers  or provides sales or support
  25. for  a  commercial  product  sold  by  the  operator  or the
  26. operator's  employer. (3)  Said system  provides message  or
  27. information forwarding services for any business concern, by
  28. which the operator is employed or compensated.
  29.  
  30. For  added measure,  let us  define a  residence BBS.  A BBS
  31. located  in a  residence is  of a  residential nature if the
  32. system meets any of the following criteria:
  33.  
  34.      (1) Said system is operated  as a non-profit hobby, and
  35. does  not receive  monthly  contributions  in excess  of the
  36. monthly operating costs of the  system including the cost of
  37. phone service.  (2) Said system  is operated for  the use of
  38. hearing-  or  speech-impaired  persons.  (3)  Said system is
  39. operated  for  message  and  information  service  of family
  40. members living at the residence.
