POLICIES, DISCLAIMERS, RULES AND REGULATIONS This System is property of DJSA Bulletin Board, Inc. Use of this system is subject to the terms and conditions as stated herein. Fraudulent or unauthorized use is a violation of applicable federal, state, and local laws. Specifications, rates, policies, and regulations are subject to change at any time and are the sole discretion of the System Operator. Notice to users of an update to those policies will be indicated by an updated bulletin message at log on time. It is the RESPONSIBILITY of each user to read and understand these policies and any updates to these policies. DJSA Bulletin Board, Inc. has established the following policies, rules and regulations. In addition, these policies, rules and regulations incorporate disclaimers and limitations. You must read, accept and agree to the rules of this Bulletin Board in order to access this system. ACCESS: ====== Access to DJSA Bulletin Board, Inc. is granted and made available on a temporary basis. This limited access is designed to introduce new users to the system. Continued use and higher access levels are only permitted after subscription fees have been received from the new user. COMPLIANCES: =========== 1. We reserve the right to refuse service to anyone. 2. DJSA Bulletin Board, Inc. is scheduled for 24 hour per day /7 days per week operations, However, there will be periods that DJSA Bulletin Board, Inc. will not be available for access. These periods include (but are not limited to) the following: 1. The period following 12:00 a.m. Eastern Standard Time for Automatic System Cleanup. 2. Those times necessary to perform software upgrades/reconfiguration and general maintenance. We are NOT responsible for loss of access due to telephone line disturbances, acts of nature or reasons beyond our control. 3. If DJSA Bulletin Board, Inc. moves its location, we may shut down the BBS and stay disconnected until the new location has been activated. If this occurs, a forwarding telephone number, will be given in the form of a referral from the old telephone number. Any shutdown because of a change in location should be completed within one week. The time lost while the system is shutdown will be added to your subscription. NOTICE: ====== Pursuant to the Electronic and Communication Privacy Act of 1986, 18 USC et. seq., Notice is hereby given that there are no facilities provided by this system for sending or receiving private and confidential electronic communications. All messages shall be deemed to be readily accessible to the general public. Do not use this system for any communication for which the sender intends only the sender and the intended recipient or recipients to read. The system operator(s) of this Bulletin Board do normally read all messages on this system as part of the normal system operation function. LIABILITY: --------- Neither DJSA Bulletin Board, Inc. or the System Manager or System Operators assume any responsibility for the accuracy of any information appearing or provided by this service, including personal communications between users. Further, no warranty is expressed or implied regarding the integrity of any information stored in this service, length of time such information may remain available, or the suitability of the information obtained through this service for the users intended application. CONTENT: ------- Any message or other information placed in this service by it's users which may appear to be, in the opinion of the Sysop, bigoted, slanderous, obviously inaccurate, offensive, or which appears to be illegal or for any other matter, will be removed. The Sysop reserves the sole right to evaluate messages or other information according to these criteria. Any attempt by any user of this BBS, either directly or indirectly, to circumvent the laws of your community is forbidden and will result in immediate termination of access. This includes, but is not limited to, dissemination of copyrighted software, gambling, or fraud. FILES: ===== Files on this system are obtained from reputable distributors. DJSA Bulletin Board, Inc. takes a number of steps to ensure the programs function are virus free. However, there is NO warranty as to the content, or performance of software obtained from our System. As a condition of your usage of this system, you agree to hold DJSA Bulletin Board, Inc. harmless for any damage, actual or consequential, caused by programs and or advice by DJSA Bulletin Board, Inc. and/or the representatives and/or users. You MUST exercise reasonable care when using any program obtained here. The material contained on this Bulletin Board is in compliance with the standards of the community the Bulletin Board is located in. If the material violates your local standards, you must destroy that material upon discovery. The Bulletin Board takes no responsibility for determining standards in effect in your community. USERS RESPONSIBILITY: -------------------- Each user of DJSA Bulletin Board, Inc. has a unique name and password. All users are expected to protect the security of their log on accounts and passwords and not to "loan" them to others. DJSA Bulletin Board, Inc. strongly discourages the inclusion, in it's information files or public message bases of such information as personal telephone numbers, credit card numbers or any other sensitive data which may be used illegally or cause embarrassment or harassment. Any individual user who chooses to do so, however, does so entirely at his or her own risk, and by doing so, personally assumes all responsibility thereof. CONFIDENTIALITY: --------------- Information submitted to DJSA Bulletin Board, Inc. will be considered STRICTLY CONFIDENTIAL. This includes information on the telephone number and the real first and last name of the user. The user grants DJSA Bulletin Board, Inc. the right to display their name/handle, their city in the users log which is available to all users of the system. Information that is learned by the System Manager or System Operator(s) is the normal course in the operating the system will also be considered strictly confidential. Within the limits of the law, it will not be divulged to anyone. USERS ACCEPTANCE: ---------------- Request for access to DJSA Bulletin Board, Inc. and use of that privilege, implies acceptance of these policies. By signing onto this system, as a validated user, all users affirm such acceptance, and agree to indemnify and hold DJSA Bulletin Board, Inc. and the System Operator(s) harmless from any and all claims and expenses, including reasonable attorney's fees, in any actions related to use of DJSA Bulletin Board, Inc. CONSEQUENCES: ------------ Disregard for and/or violation of the above policies, as well as any use of the information or message bases for illegal purposes, or ANY attempt to penetrate the operating system or to attempt to interface with its operation, or supplying any information or assistance to another attempting to do so, shall be sufficient cause for immediate termination of access privileges, at the sole discretion of the System Operator. Additionally, the System Operator(s) may choose to utilize any legal resources as appropriate to the circumstances involved. DELETING USERS: ============== DJSA Bulletin Board, Inc. and it's owner reserves the right at ANYTIME to delete a user or users without notice. This deletion process may only be done by the system operator. USAGE: ===== Frequency of usage to DJSA Bulletin Board, Inc. will be different for each caller. A caller who joins our BBS might call every day or may not call more than once each month. We do have callers who log in for their initial call and never call back. We do not monitor the frequency of usage nor do we expect callers to use our BBS in any scheduled way. Each caller will determine their own frequency of usage. We cannot be held responsible for callers who have lost our telephone number and therefore have not called frequently enough to satisfy their value for subscription dollar. Therefore, DJSA Bulletin Board, Inc. will NOT be held responsible for any lack of usage by subscribers and will not refund subscription dollars. RATE INCREASES: ============== DJSA Bulletin Board, Inc. automatically increases rates every six months. If you continue your subscription, the rate increase will be added to your statement automatically. The increase will be $5.00 but will hold for one full year after the increase. We will send you a notice by E-Mail at least 30 days prior to a rate increase if you are going to be included. It is your responsibility to log on to BBS frequently enough to be aware of the increase. REFUNDS: ======= In short, there are NO refunds on DJSA Bulletin Board, Inc. If you have signed up for a subscription and decide to cancel for ANY reason, we will NOT refund any unused portion of your subscription. If your account is terminated for a violation of BBS policy, a breech of your contract with us, or a violation of any law, whether, federal, state or local, we will NOT refund unused portion of your subscription. In event of DJSA Bulletin Board, Inc. cessation or prolonged shutdown, you will be contacted for options you have in applying unused subscription time. In the event that DJSA Bulletin Board, Inc. changes it's location, we will only refund the unused portion of subscriptions for local callers who will not call to the new location because of long distance charges. If we move our location and the end result would be no change in long distance charges, we will NOT refund any unused subscription. Any user who signs up for CompuPay, will have fees deducted from their checking account each month. The deductions are made on the 1st or 15th of each month. Usually the date the deduction occurs is approximately 2-3 weeks after you sign on. Once a debit has been authorized it cannot be cancelled until the next month. It takes at least two weeks to stop the process once it has started. We will continue to debit your checking account until written notification is given to cancel the account. PAYMENT: ======== We offer two methods of payment....... COMPUPAY (Automatic Bank Draft) You can gain immediate access to DJSA Bulletin Board, Inc. by agreeing to pay your subscription with COMPUPAY. We will be able, after you agree, to transfer your subscription fee by use of an automatic bank draft. Your bank draft will continue until you advise us to cancel it. PAY BY CHECK ACCOUNTS You can gain immediate access to our BBS by agreeing to pay for your subscription by sending us a check or money order in the mail. We will require your bank information so that we can deduct the payment from your account if you haven't paid it by the due date. See the CompuPay info for more details. Monthly Rate Hours Per Day Access Available $14.95 ........... 1 hour per day ........... Basic Services $19.95 ........... 5 hours per day .......... Full NET Access Until we verify the information you have given, we will grant you temporary access to this BBS. If all is fine, we will adjust your security level to reflect your subscription choice in a few days. GENERAL CONDUCT: =============== You must: a. Respect the rights of other users of this system. b. Never pretend to be a different person. c. Never post/send any messages that is harassing, or contains threats. d. Never let anyone else use your account. e. Never give out your password.
