- The account is due every month on the same date you originally signed up with
- SNNI. There are two methods of payment: check and credit card. Every month a
- check must be mailed no later than five days after your billing date for your
- account to be kept active and to avoid any resetup fees. A credit card is
- charged every month on the date that the account was established.

- The agreement is between located
- in , hereinafter referred
- to as Subscriber and Southwest Nineteen Networks located in Anaheim, California
- (collectively referred to as Parties). Whereas Southwest Nineteen Networks has
- agreed to provide computing and networking services to the Subscriber; whereas
- Subscriber desires to become affiliated with the Southwest Nineteen Networks by
- connecting to Southwest Nineteen Networks' network Services.

- Now therefore, the Parties agrees as follows:

- 1. Southwest Nineteen networks agrees to allow Subscriber to connect to
- computing facilities at Subscribers site to Southwest Nineteen Networks' network
- and transmit data over the Network in accordance with the terms of these
- Subscription Rules and the Southwest Nineteen Networks Customer Service
- Agreement form which is attached hereto as Form A and made a part hereof.

- 2. Subscriber shall pay chosen payment as stated in Form A for connection
- and use of Southwest Nineteen Networks' network. Failure to comply with the
- chosen payment schedule may result in cancellation of network services.

- 3. Southwest Nineteen Networks reserves the right to change the above terms
- and conditions by notifying the Subscriber in writing or in E-mail at least 30
- days in advance.

- 4. Neither Party shall have the right to use the other's name, trademark or
- tradename, or to refer to this Agreement in connection with any product,
- promotion without prior consent of the other Party.

- 5. No information exchanged between the Parties shall be considered
- confidential unless it is the subject of a separate written confidential
- non-disclosure agreement.

- 6. This Agreement will be effective upon signature by both Parties and may be
- terminated by either Party immediately upon written notice to the other Party
- provided; however, that the provision of Paragraphs 7 and 8 shall survive any
- termination. Subscriber is thus responsible for any outstanding service fees.

- 7. Southwest Nineteen Networks, any and all other participating Southwest
- Nineteen Networks network contractors and grantees, and officers and employees
- are not authorized to make any affirmation or fact of warranty with respect to
- the software or hardware supplied under this Agreement and Southwest Nineteen
- Networks HEREBY EXPRESSLY DISCLAIMS ALL EXPRESSED AND IMPLIED WARRANTIES,
- INCLUDING, WITHOUT LIMITATION, WARRANTIES OR MERCHANTABILITY, FITNESS FOR A
- PARTICULAR PURPOSE, AND INFRINGEMENT OR PROPRIETARY INTEREST AND SHALL NOT BE
- LIABLE TO SUBSCRIBER FOR DIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL USE OR
- INABILITY TO USE THE SOUTHWEST NINETEEN NETWORKS' HARDWARE OR SOFTWARE.

- 8. The Subscriber shall indemnify and hold Southwest Nineteen Networks, their
- officers, employees and agents harmless from and against any and, all damages,
- liabilities, losses, cost and expenses, including reasonable attorney's fees,
- arising out of or related to Subscribers use of the Networks or Subscriber's
- breach of the terms and conditions of this Agreement.

- 9. This agreement and the legal relationships between the Parties shall be
- governed by the laws of the State of California.

- 10. This Agreement, including Form A, is the sole Agreement between the
- Parties respecting the subject matter hereof. Subscriber has read this
- Agreement and fully understands the terms thereof. This Agreement
- supersedes all prior agreements and understandings, whether oral or written.
- This Agreement may only be changed or terminated in writing, signed by both
- Parties.

- 11. The Subscriber shall read, fully understand and abide by Form A

- Welcome ExoCom User to Southwest Nineteen Networks

- As a new user you might require information on how exactly to use your
- account. You can use either a Unix shell or a SLIP/PPP account to connect to
- the Internet. For Unix, a good Unix book or class is best to understand all the
- features of Unix. To login to your Unix Shell account simply at "login:" type your
- login name followed by your password. You will be given you Unix Shell
- prompt. If you are want a Menu system, it can be accessed by typing "menu".
- Although this contains many of the common features is doesn't provide all the
- commands you can use in Unix. For a brief listing of Unix commands you may
- consult the ExoCom Internet User Guide.

- If you are a Windows 3.11 user you can download ExoCom easy to use install
- diskette. This is located in FTP.EXO.COM. You can "FTP" (transfer) the file to
- your directory to and send it your computer using the "Send Z-Modem"
- command (sz). These would be the exact commands.

- Call your local dial-up number with a terminal emulation program using 8N1 that
- supports Z-Modem Transfer

- At the "login:" prompt type your username (the login name).

- Rate.

- Select and type the correct information for your account and computer settings.
- With the mouse press "OK". A program group in Windows will be created
- called ExoCom. There will be a number of programs such as TCP Manager,
- News, Mail, FTP and Netscape. Clicking on TCP Manager will dial our Network
- with the settings you selected. Once connected and PPP is enable you can
- Click on Mail, News, FTP or Netscape to either Read Mail or News, Send a file
- in FTP or view the World Wide Web with Netscape. The Programs are pretty
- self explanatory so great detail will not be given in this text to their individual
- use. For more information on each program contact the author or E-Mail
- Southwest Nineteen Networks.

- For Windows 95, use the built-In TCP/IP features of Windows 95. We do not
- have an install disk for Windows 95, but we have a file on how to setup
- Windows 95 on your computer. For information on downloading that file please
- download the Windows PPP config file information located on FTP.EXO.COM
- the pub/win95ppp.txt file or contact ExoCom Technical Support at
- 714-518-2040 if you would like the Information faxed or mailed to you.

- Macintosh Users will need to have MacTCP (included with System 7.5) and
- MacPPP as well as the client software for accessing the Internet. If you do not
- have that software it can be purchased at a major Computer Retail Store. The
- book is called Internet Starter Kit. It contains one diskette that Includes
- MacTCP, MacPPP. MacWeb and other various programs needed for Internet
- access. Setup information for Macintosh for use with Southwest Nineteen
- Networks can be supplied. The software and book can be sent to you if you
- require. Please contact Southwest Nineteen Networks if you would like the
- book and diskettes.

- your end also. For SLIP or CSLIP a "S" or "C" must be put in
- front or the login name. Once the password is typed the IP
- information is sent. Your SLIP or CSLIP software must grab
- this information each time for the correct IP for that session.
