  43. SUMMARY: This final rule adds methyl isobutyl ketone (MIBK) 
  44. as a List II Chemical under the Controlled Substances Act (CSA). 
  45. This action is based on substantial evidence that MIBK is increasingly 
  46. being used as a solvent in the production of cocaine hydrochloride 
  47. during the conversion of cocaine base to cocaine hydrochloride. 
  48. The recent steps by the Government of Columbia (GOC) to control 
  49. MIBK further support this action.
  50.  
  51.    This action will only affect specific types of transactions 
  52. which are greater than 500 gallons or 1523 kilograms of MIBK 
  53. destined for countries in the Western Hemisphere (with the exception 
  54. of transactions destined for Canada). These transactions include 
  55. (1) export transactions; (2) international transactions in which 
  56. a U.S. broker or trader participates; and (3) transshipments 
  57. through the U.S.

  67. SUPPLEMENTARY INFORMATION: The Controlled Substances Act (CSA). 
  68. specifically 21 U.S.C. section 802, provides the Attorney General 
  69. with the authority to specify by regulation, additional precursor 
  70. and essential chemicals as ``listed chemicals'' if they are 
  71. used in the illicit manufacture of controlled substances. Section 
  72. 802(39) also provides the Attorney General with authority to 
  73. establish a threshold amount for ``listed chemicals'' if the 
  74. Attorney General so elects. This authority has been delegated 
  75. to the Administrator of DEA by 28 CFR 0.100 and redelegated 
  76. to the Deputy Administrator under 28 CFR 0.104 (Subpart R) Appendix 
  77. Sec. 12.

  79.    On February 28, 1995 the Deputy Administrator of the Drug 
  80. Enforcement Administration (DEA) published a Notice of Proposed 
  81. Rulemaking (60 FR 10814). This notice proposed the addition 
  82. of methyl isobutyl ketone (MIBK) as a List II Chemical under 
  83. the Controlled Substances Act (CSA). Interested parties were 
  84. given 30 days in which to submit comments and objections.
  85.    Only one comment was received in response to the Notice of 
  86. Proposed Rulemaking. This comment requested further clarification 
  87. of the meaning of the term ``Western Hemisphere''. Webster's 
  88. II New Riverside University Dictionary defines the term ``Western 
  89. Hemisphere'' to mean, ``The half of the earth that includes 
  90. North and South America, the surrounding waters, and all neighboring 
  91. islands''. For purposes of this rulemaking, this is the definition 
  92. that the DEA is adopting.
  93.    While methyl ethyl ketone (MEK) has become the solvent of 
  94. choice in the processing of cocaine base to cocaine hydrochloride, 
  95. recent regulatory and enforcement efforts in Latin America have 
  96. resulted in a reduced availability of MEK. Information available 
  97. to DEA indicates that in response to this shortfall of MEK, 
  98. cocaine laboratory operators have moved to the utilization of 
  99. MIBK for the processing of cocaine base to cocaine hydrochloride. 
  100. Due to information regarding the use of MIBK for cocaine processing, 
  101. the dramatic increase in MIBK importation, and the importation 
  102. of MIBK by some firms that the Government of Colombia (GOC) 
  103. considers suspect, the GOC has recently taken steps to control 
  104. the sale and distribution of MIBK.
  105.    The United States is a major producer of MIBK and exports 
  106. MIBK to Colombia and other countries within Latin America. In 
  107. light of the above, the DEA has determined that the control 
  108. of MIBK as a List II Chemical under the CSA is warranted. Since 
  109. the illicit use of MIBK for cocaine processing occurs in Latin 
  110. America, MIBK shipments exported from the U.S., shipments transshipped 
  111. or transferred through the U.S., and international transactions 
  112. in which a U.S. broker or trader participates, shall be considered 
  113. regulated transactions if destined for any country in the Western 
  114. Hemisphere (with the exception of transactions destined for 
  115. Canada) 21 U.S.C. section 802(39)(A)(iii). In addition, a threshold 
  116. similar to that of MEK shall be established for MIBK. A threshold 
  117. of 500 gallons (by volume) or 1523 kilograms (by weight) shall 
  118. be established for MIBK. Therefore, this action will only effect 
  119. specific types of transactions which are greater than 500 gallons 
  120. or 1523 kilograms of MIBK destined for designated countries. 
  121. These transactions include (1) export transactions; (2) international 
  122. transactions in which a U.S. broker or trader participates; 
  123. and (3) transshipments through the U.S. Import transactions 
  124. of MIBK into the U.S. (not destined for transshipment or transfer 
  125. to designated countries), and domestic transactions of MIBK 
  126. are excluded from the definitions of regulated transactions 
  127. contained in 21 CFR 1310.01(f) and 1313.02(d).
  128.    The Deputy Administrator hereby certifies that this rulemaking 
  129. will have no significant impact upon entities whose interests 
  130. must be considered under the Regulatory Flexibility Act, 5 U.S.C. 
  131. 601 et seq. A review of maritime shipments of MIBK reveals that 
  132. during a two year period, there were less than 
  133.

  136. 100 above-threshold export transactions destined for designated 
  137. countries. This rule is not a significant regulatory action 
  138. and therefore has not been reviewed by the Office of Management 
  139. and Budget pursuant to Executive Order 12866.
  140.    This action has been analyzed in accordance with the principles 
  141. and criteria in E.O. 12612, and it has been determined that 
  142. the rule does not have sufficient federalism implications to 
  143. warrant the preparation of a Federalism Assessment.
