  1. Use of Capture Professional indicates agreement to the following

  4. Creative Softworx believes that the software will perform substantially
  5. in accordance with the documentation and that the diskettes and 
  6. documentation are free from defects in materials and workmanship.

  8. If you discover defective diskette or documentation we will replace 
  9. them upon notification.  If the software does not perform as documented, 
  10. we will attempt to correct and replace it within a reasonable period of 
  11. time after receipt of written notification describing the problem.

  13. Creative Softworx specifically disclaims all warranties, including, 
  14. without limitation, all implied or inferred warranties of merchantability, 
  15. fitness for a particular purpose, and non-infringement of third party rights.  
  16. It is your responsibility to determine the fitness of the product for any 
  17. particular purpose.

  19. Under no circumstances will Creative Softworx be liable for special, 
  20. incidental, consequential, indirect or any other damages or claims arising 
  21. from the use of this product, including loss of profits or any other 
  22. commercial damages, even is Creative Softworx has been advised of the 
  23. possibility of such damages.
