  1.               ELEMENTS OF COURT/POLITICAL STRATEGY

  3.      Research all pertinent statutes, rules, regulations, 
  4. legislative history, court cases, and treatises.  In short, 
  5. become expert on the narrow points of law of the case.  Get a 
  6. guide to "A Guide to Federal Agency Rule Making."
  7.  
  8.      Project the position of underdog, intelligence, honesty, 
  9. fear, indignation, issue of principle, belief, determination, 
  10. calm, non-antagonism, non-arrogance.
  11.  
  12.      Don't do, say or write anything that may be used against you 
  13. legally or politically (foul language, threats, radical 
  14. invectiveness, and so on).
  15.  
  16.      Draw battle-lines on important political issue championed by 
  17. many of the public, even if of secondary importance to the cause.
  18.  
  19.      Publicity:  Expose wrong-doing by government/court.
  20.  
  21.      Limit opponents options through unilateral discovery, FOIA, 
  22. jurisdiction, public acceptance of one's behavior, condemnation 
  23. of adversaries' acts.

  25.      Don't limit own options:  Do not itemize defenses or give 
  26. information enabling preparation to meet defense or amendment of 
  27. charge to self detriment.

  29.      Ensure credibility:  Only one adversary per battle if 
  30. possible.  Do not add names or issues to the debate.
  31.  
  32.      Do not alienate any potential supporters by ignoring the 
  33. "one adversary, one issue" rule.
  34.  
  35.      Do not appear to be a legal know-it-all.  It may work in a 
  36. seminar but no chance with the general public.  Ideally the legal 
  37. knowledge or other assistance comes from "unknown" supporters.

  39.      If public perceives that subject is capable of handling 
  40. himself and is not the underdog, then public will not give 
  41. support, especially if a subject goes on the offensive (as in 
  42. filing a court suit).

  44.      Assemble ideal defense team with these attributes:

  46.           Political advisor
  47.           Public relations man/media liaison
  48.           Charismatic trial lawyer
  49.           Expert in law theory
  50.           Expert in legal issue at bar
  51.           Expert in court rules and procedure
  52.           Law clerk/researcher
  53.           Constitutionalist/historian
  54.           Courier
  55.           Resource/Funding
  56.      Do not sign your name frivolously
