  7. As an employer, you need to be alert to your obligations
  8. under a number of federal and state laws that prohibit
  9. discrimination in employment on the basis of sex, age, race,
  10. color, national origin, religion, or on account of mental
  11. or physical handicaps.  These anti-discrimination laws are
  12. not just limited to hiring practices, but relate to almost
  13. every aspect of the relationship between employer and
  14. employee, including compensation, promotions, type of
  15. work assigned and working conditions.

  17. In addition to outlawing discrimination in employment,
  18. companies contracting for business with the federal
  19. government are generally required to adopt affirmative
  20. action programs in employment of minorities, women, the
  21. handicapped, and Vietnam veterans.  Affirmative action
  22. programs (actively seeking to hire persons from those
  23. groups) are not generally required if your firm is not a
  24. government contractor.

  26. Federal anti-discrimination requirements that you should
  27. take note of as a small business owner are summarized
  28. briefly below.

  30.     . EMPLOYERS SUBJECT TO FEDERAL ANTI-DISCRIMINATION
  31.       LAWS.  The federal anti-discrimination laws (other
  32.       than the requirement that women receive equal pay
  33.       for equal work, as compared to men) generally do not
  34.       apply to small firms with less than 15 employees,
  35.       unless they work on government contracts or
  36.       subcontracts.  The various major federal enactments

  111.   . FORMAL COMPLIANCE REQUIREMENTS.  There is very little
  112.     in the way of filling out forms and other paperwork
  113.     required of small businesses in connection with the
  114.     federal laws against job discrimination.  However, if
  115.     you are subject to any of the above laws, there are
  116.     government posters for each that you must obtain and
  117.     post in your workplace.  Also, an employer with more
  118.     than 100 employees must file Form EEO-1 with the Equal
  119.     Employment Opportunity Commission each year.

  138.     to demonstrate that your firm has not discriminated
  139.     against any group or individual member of a particular
  140.     group in violation of federal or state laws.

  146.   . CALIFORNIA REQUIREMENTS.  California has its own state
  147.     anti-discrimination laws, even more wide-reaching
  148.     than the federal laws, including local ordinances in
  149.     some communities, such as "gay rights" provisions
  150.     adopted in San Francisco, prohibiting discrimination
  151.     based on sexual preference.

  153.     California's fair employment laws apply to any employer
  154.     that regularly employs 5 or more persons, making it
  155.     illegal for an employer to discriminate because of race,
  156.     color, religious creed, national origin, ancestry,
  157.     physical handicap, medical condition, marital status, or
  158.     sex.  Sexual harassment is prohibited as a discriminatory
  159.     practice under state law.
