  4. Two court decisions go in opposite directions on environmental
  5. hazards

  8.     Talk about double messages. Two federal courts have come out
  9. with decisions that could 1) limit and 2) increase the number of
  10. toxic chemicals to which Americans are exposed. The first
  11. concerns four pesticides -- used on crops including tomatoes,
  12. fruits and grains -- that cause cancer in laboratory animals.
  13. When these crops are processed into jellies, say, or catsup, the
  14. pesticides become more concentrated than they are in the field.
  15. Even then, the Environmental Protection Agency says, the risk
  16. of cancer is 1 in a million at most, and the chemicals should
  17. stay on the market.

  19.     But a 1958 law says any risk at all is unacceptable, and
  20. a San Francisco court ruled that the epa must ban the four; 31
  21. others will probably be affected too, and 30 more could be. That
  22. adds up to 20% of all pesticides used on crops. The EPA is
  23. deciding whether to appeal -- and the pesticide industry is
  24. holding its breath.

  26.     The other ruling involves worker safety: in 1989 the
  27. Occupational Safety and Health Administration limited workplace
  28. exposure to more than 400 toxic substances. But OSHA didn't make
  29. a separate case for each, as the law requires. Though that would
  30. have taken decades, an Atlanta court said the limits are
  31. invalid. Workers shouldn't panic: it's unlikely that companies
  32. that have spent millions to comply with OSHA's standards will
  33. now spend even more to have safeguards removed.
