  1. PrivNet Beta License Agreement
  2.  
  3. BEFORE YOU CLICK ON THE "ACCEPT" BUTTON AT THE END OF THIS
  4. DOCUMENT, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS
  5. AGREEMENT.  BY CLICKING ON THE "ACCEPT" BUTTON, YOU ARE
  6. CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS
  7. AGREEMENT.  IF YOU DO NOT AGREE TO ALL OF THE TERMS AND
  8. CONDITIONS OF THIS AGREEMENT, CLICK THE "DO NOT ACCEPT" 
  9. BUTTON AND DO NOT USE THE SOFTWARE.

  11. 1. Grant of License. In this beta license agreement
  12. ("License"), PrivNet, Inc. ("PrivNet") grants you  a non-
  13. exclusive, non-transferable, non-sublicensable license to
  14. use one copy of the beta test version of the interactive
  15. software program entitled "Internet Fast Forward"
  16. ("Software"), in binary executable form for internal
  17. purposes only on one computer.  THE SOFTWARE CONTAINS CODE
  18. THAT DISABLES MOST OF ITS FEATURES AFTER NOVEMBER 14, 1996.
  19.  
  20. 2. Commercial Release.  While PrivNet intends to distribute
  21. a commercial release of the Software, PrivNet reserves the
  22. right at any time not to release a commercial release of the
  23. Software or, if it does so, to alter prices, features,
  24. specifications, capabilities, functions, licensing terms,
  25. release dates, general availability, or other
  26. characteristics of the commercial release.
  27.  
  28. 3. Copyright.  The Software is owned by PrivNet or its
  29. suppliers or licensors and is protected by United States
  30. copyright laws and international treaty provisions.
  31. Therefore, you may not use, copy, or distribute the Software
  32. without authorization.  This License authorizes you to (a)
  33. make one copy of the Software solely for backup or archival
  34. purposes, or (b) transfer the Software to a single hard
  35. disk, provided you keep the original solely for backup or
  36. archival purposes.

  38. 4. Other Restrictions.  You may not rent, lease, or loan the
  39. Software, transfer your rights therein, or reverse engineer,
  40. decompile, or disassemble the Software, except to the extent
  41. the foregoing restriction is expressly prohibited by
  42. applicable law.  You may not modify or create derivative
  43. works based upon the Software, in whole or in part.

  45. 5. NO WARRANTY. THE SOFTWARE IS AN UNTESTED BETA VERSION AND
  46. IS PROVIDED "AS IS."  YOU ASSUME THE ENTIRE COST OF ANY
  47. DAMAGE RESULTING FROM THE INFORMATION CONTAINED IN OR
  48. PRODUCED BY THE SOFTWARE.  YOU ASSUME ALL RESPONSIBILITIES
  49. FOR SELECTION OF THE SOFTWARE  TO ACHIEVE YOUR INTENDED
  50. RESULTS, AND FOR THE INSTALLATION OF, USE OF, AND RESULTS
  51. OBTAINED FROM THE SOFTWARE.  TO THE MAXIMUM EXTENT PERMITTED
  52. BY APPLICABLE LAW, PRIVNET DISCLAIMS ALL WARRANTIES, EITHER
  53. EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED
  54. WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  55. PURPOSE, AND NON-INFRINGEMENT, WITH RESPECT TO THE SOFTWARE.
  56. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES,
  57. SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

  59. 6. ADDITIONAL DISCLAIMER.  BY USING THE SOFTWARE, YOU
  60. ACKNOWLEDGE THAT ITS PRIMARY PURPOSE IS TO BLOCK
  61. ADVERTISEMENTS FROM BEING DISPLAYED TO YOU DURING THE
  62. VIEWING OF WEB PAGES WITH A BROWSER PROGRAM.  ADVERTISEMENTS
  63. ARE IDENTIFIED BY PRIVNET ACCORDING TO THE INFORMATION
  64. CURRENTLY AVAILABLE TO PRIVNET REGARDING THE LOCATION,
  65. DESCRIPTION, AND NATURE OF CONTENT THAT CONSTITUTES
  66. ADVERTISEMENT.  AS A RESULT, CERTAIN CONTENT MAY NOT BE
  67. DISPLAYED TO YOU EVEN THOUGH SUCH CONTENT IS NOT AN
  68. ADVERTISEMENT, AND SIMILARLY, CERTAIN ADVERTISEMENTS MAY BE
  69. DISPLAYED TO YOU.  PRIVNET CANNOT AND DOES NOT GUARANTEE
  70. THAT THE SOFTWARE WILL BLOCK ACCESS TO ALL ADVERTISEMENTS,
  71. OR THAT THE SOFTWARE WILL NOT BLOCK ACCESS TO CONTENT THAT
  72. DOES NOT CONSTITUTE ADVERTISEMENT.

  74. 7. LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED
  75. BY APPLICABLE LAW, IN NO EVENT SHALL PRIVNET OR ITS SUPPLIERS
  76. BE LIABLE FOR ANY CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING,
  77. WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, 
  78. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER
  79. PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE
  80. THIS PRIVNET PRODUCT, EVEN IF PRIVNET HAS BEEN ADVISED OF
  81. THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME STATES DO NOT
  82. ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR
  83. CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION
  84. MAY NOT APPLY TO YOU.

  86. 8. Term.  Unless sooner terminated, this Agreement shall be
  87. effective as of the date you click on the "ACCEPT" button,
  88. and shall continue in full force and effect until commercial
  89. availability of the Software.  PrivNet may terminate this
  90. Agreement, for any reason or no reason, upon written notice.
  91. Upon termination of this License, or in any event thirty
  92. (30) days following PrivNet's release of a commercial
  93. version of the Software, you agree to destroy or erase the
  94. Software.  Provisions 2, 3, 5, 6, 9 and 10 of this License
  95. shall survive the term of this License.

  97. 9. U.S. Government-Restricted Rights.  The Software and
  98. accompanying documentation are deemed to be "commercial
  99. computer software" and "commercial computer software
  100. documentation," respectively, pursuant to DFAR Section
  101. 227.7202 and FAR Section 12.212, as applicable.  Any use,
  102. modification, reproduction release, performance, display or
  103. disclosure of the software and accompanying documentation by
  104. the U.S. Government shall be governed solely by the terms of
  105. this Agreement and shall be prohibited except to the extent
  106. expressly permitted by the terms of this Agreement.

  108. 10.  Governing Law.  This License is governed by the laws of
  109. the United States and the State of North Carolina, without
  110. reference to conflict of laws principles.  This Agreement is
  111. the entire agreement between you and PrivNet and supersedes
  112. any other communications or advertising with respect to the
  113. Software and documentation.  If any provision of this
  114. License is held invalid, the remainder of this License shall
  115. continue in full force and effect.  Should you have any
