  4. BEFORE YOU USE THIS SOFTWARE, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS
  5. AGREEMENT. BY USING THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY AND ARE
  6. BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS
  7. OF THIS AGREEMENT, DO NOT USE THE SOFTWARE.

  9. 1. YAMAHA Corporation ("YAMAHA") grants to you a non-exclusive,non-sublicensable,
  10. license to use this Beta version of the YAMAHA MIDPLUG (the
  11. "Software"), in binary executable form for evaluation and trial use purposes
  12. only. THIS SOFTWARE CONTAINS CODE THAT DISABLES MOST OF ITS FEATURES AFTER
  13. November.30,1996.

  15. 2. YAMAHA MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SOFTWARE OR
  16. ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY
  17. PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES,
  18. INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
  19. OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND, ACCORDINGLY,
  20. YAMAHA SHALL NOT BE LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY YOU OR

  25. content owner and may be protected by applicable copyright law. This License
  26. gives you no rights to such content.

  28. 4. While YAMAHA intends to distribute a commercial release of the Software, 
  29. YAMAHA reserves the right at any time not to release a commercial release of
  30. the Software or, if released, to alter prices,features, specifications,
  31. capabilities, functions, licensing terms, release dates, general availability
  32. or other characteristics of the commercial release.

  35. Software shall remain in YAMAHA. You agree to abide by the copyright law and
  36. all other applicable laws of Japan including,but not limited to, export
  37. control laws. You acknowledge that the Software in source code form remains a
  38. confidential trade secret of YAMAHA and therefore you agree not to modify the 
  39. Software or attempt to decipher,decompile, disassemble or reverse engineer the
  40. Software, except to the extent applicable laws specifically prohibit such 
  41. restriction.

  43. 6. YAMAHA may terminate this License at any time by delivering notice to you
  44. and you may terminate this License at any time by destroying or erasing your
  45. copy of the Software. Upon termination of this License, or in any event with
  46. in thirty (30) days following YAMAHA's release of a commercial version of the
  47. Software, you agree to destroy or erase the Software. In the event of
  48. termination, the following sections of this License will survive: 2, 3, 4, 5,
  49. 6,and 7. This License is personal to you and you agree not to assign your
  50. rights herein. This License shall be governed by and construed in accordance
  51. with the laws of Japan and, as to matters affecting copyrights, trademarks and
  52. patents, by Japanese law. This License sets forth the entire agreement between
  53. you and YAMAHA.

  55. 7. YAMAHA SHALL NOT BE LIABLE FOR (a) INCIDENTAL,CONSEQUENTIAL,SPECIAL OR
  56. INDIRECT DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE,
  57. EVEN IF YAMAHA HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR (b)
  58. FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY
  59. TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW
  60. PROHIBITS SUCH LIMITATION. FURTHERMORE,SOME STATES DO NOT ALLOW THE EXCLUSION
  61. OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND
  62. EXCLUSION MAY NOT APPLY TO YOU.
