  3.     DISCLAIMER - AGREEMENT

  5.     Users of AquaScape must accept this disclaimer of warranty:
  6.     AquaScape is supplied as is.  Run Productions disclaims all
  7.     warranties, expressed or implied, including, without limitation,
  8.     the warranties of merchantability and of fitness for any purpose.
  9.     Neither Run Productions nor anyone else who has been involved in
  10.     the creation, production, or delivery of this software shall be
  11.     liable for any indirect, consequential, or incidental damages
  12.     arising out of the use or inability to use such software even if
  13.     Run Productions has been advised of the possibility of such
  14.     damages or claims.  In no event shall Run Productions' liability 
  15.     for any damages ever exceed the price paid for the license to use
  16.     the software, regardless of the form of claim.  The person using
  17.     the software bears all risk as to the quality and performance of
  18.     the software.

  20.     This agreement shall be governed by the laws of the state of
  21.     Tennessee and shall insure to the benefit of Run Productions and
  22.     any successors, administrators, heirs, and assigns.  Any action
  23.     or proceeding brought by either party against the other arising
  24.     out of or related to this agreement shall be brought only in a
  25.     state or federal court of competent jurisdiction located in
  26.     Tennessee.  The parties hereby consent to in personam
  27.     jurisdiction of said courts.

  29.     This software is licensed to you for your own use.  This is
  30.     copyrighted software.  You are not obtaining title to the 
  31.     software or any copyright rights.  You may not sublicense, rent,
  32.     lease, convey, modify, translate, convert to another programming
  33.     language, decompile, or disassemble the software for any purpose.

  35.     AquaScape is a "shareware program" and is provided at no charge
  36.     to the user for evaluation.  Feel free to share it with your
  37.     friends, but please do not give it away altered or as part of
  38.     another system.  The essence of "user-supported" software is to
  39.     provide personal computer users with quality software without
  40.     high prices, and yet to provide incentive for programmers to
  41.     continue to develop new products.  If you find this program
  42.     enjoyable and find that you are using AquaScape and continue to
  43.     use AquaScape after a reasonable trial period, please purchase
  44.     the commercial version from Run Productions.

  46.     Anyone distributing AquaScape for any kind of remuneration must
  47.     first contact Run Productions for written authorization.  This
  48.     authorization will be granted freely to distinguished distributors,
  49.     but written permission must be obtained in order to insure the
  50.     latest version is being distributed.

  52.     You are encouraged to pass a copy of the shareware version of
  53.     AquaScape along to your friends for evaluation, as long as the
  54.     archive is the original one and is not altered or modified in
  55.     any way.
