  3. "This Prenuptial Agreement, hereinafter referred to as 'Agreement,' is
  4. "made by and between \a and \b, and entered into in consideration of
  5. "the contemplated marriage of the above-named parties. This Agreement
  6. "shall not be effective until the marriage contemplated by the parties
  7. "is solemnized.
  8. "
  9. "     This Agreement is made on the basis of the parties' contemplation
  10. "of marriage to one another in the immediate future, as well as their
  11. "desire to define their respective rights, entitlements, and
  12. "responsibilities regarding each other's property and financial
  13. "matters.
  14. "
  15. "     Each party agrees to be separately liable for his or her debts
  16. "incurred prior to the marriage.
  17. "
  18. "     Both parties to this Agreement understand that the Uniform
  19. "Premarital Agreement Act and court decisions provide for consideration
  20. "by the Court of a premarital agreement if a marriage is dissolved. The
  21. "parties to this Agreement understand that some courts have disregarded
  22. "provisions in a premarital agreement that provide for disposition of
  23. "property in the event of a dissolution. Without anticipating a
  24. "dissolution or planning for a dissolution, but recognizing the
  25. "realities of the world, it is the express intention of the parties
  26. "that this Agreement shall remain in full force and effect in the event
  27. "of a dissolution, and that in such an event,
  28. "
  29. " a) each party shall have an equal interest in the property acquired
  30. "by the parties during the course of the marriage (and which is not
  31. "merely the result of increase in value of any of the property owned by
  32. "the parties prior to the marriage, as listed on the attached Financial
  33. "Exhibits), and 
  34. "
  35. "b), all savings, investments, retirement accounts, and property listed
  36. "on the attached schedules as property owned by either party prior to
  37. "the marriage shall remain the property of the person who brought such
  38. "property into the marriage. Any appreciation, income or other increase
  39. "to such property shall remain the property of the person who brought
  40. "such property into the marriage.
  41. "
  42. "     If the parties decide to revoke this Agreement, they shall do so
  43. "in a written agreement, signed by both parties in the presence of a
  44. "notary public or other official authorized to take oaths.
  45. "
  46. "     Additionally, each party has full knowledge of the terms and
  47. "provisions of this Agreement. Specifically, the parties acknowledge
  48. "and agree that they have disclosed to the other party the extent and
  49. "probable value of their respective individual property interest as of
  50. "the date of this Agreement via the Financial Exhibits attached hereto,
  51. "which are understood and agreed by the parties to represent a complete
  52. "and truthful listing of their respective property interest as of the
  53. "date of this Agreement.
  54. "
  55. "     This Agreement sets forth the entire agreement between the
  56. "parties, and shall be binding upon and inure to the benefit of the
  57. "parties and their respective heirs, administrators, personal
  58. "representatives, successors and assigns.
  59. "
  60. "     If any of the provisions of this Agreement shall be held to be
  61. "invalid or unenforceable for any reason, the remaining provisions
  62. "shall continue to be valid and enforceable. If a court finds that any
  63. "provision for this Agreement is invalid or unenforceable, but that by
  64. "limiting such provision it would become valid or enforceable, then
  65. "such provision shall be deemed to be written, construed and enforced
  66. "as so limited.
