  43.  contain both the Software Program as a component of the Product, and a
  44.  component or components (other than the Software Program) that provide
  45.  the material functionality of the Product.  If the Product is released
  46.  in source form, the Software Program or any of its components may only
  47.  be included in executable form.

  49.  2.4. "Software Program" shall mean the computer software and license
  50.  file provided by TSI under this Agreement, including all new releases,
  51.  corrections, enhancements and updates to such computer software, which
  52.  TSI makes generally available and which Licensee receive pursuant to
  53.  Licensee subscription to TSIMS. Some specific features or platforms
  54.  may not be enabled if they do not fall under the feature set(s)
  55.  covered by the specific license fees paid.

  57.  2.5 "End User" shall mean the customers of the Licensee or any
  58.  recipient of the Product whether or not any payment is made to use
  59.  the Product.
