  1. BY INSTALLING THIS SOFTWARE YOU INDICATE YOUR ACCEPTANCE OF THE FOLLOWING TERMS 
  2. AND CONDITIONS:

  6. LICENSE AGREEMENT
  7. 1. Title to the licensed software is not transferred to the customer.  Customer 
  8. is granted an exclusive license to use the licensed software on a SINGLE computer 
  9. or workstation.  EACH computer or computer workstation must have its own licensed 
  10. copy.
  11.  
  12. COPYING RESTRICTIONS
  13. 2.  Customer may make backup copies of the software for archival purposes only.  
  14. No more than one (1) copy may be in existence at any one time.  Each copy shall 
  15. include in readable format any and all confidential, proprietary and copyright 
  16. notices or markings contained on the original provided by Aimsoft Development 
  17. Corporation (ADC).

  19. PATENT AND COPYRIGHT PROTECTION
  20. 3. The licensed software is protected by the copyright laws of the United States, 
  21. the State of Nevada, and other proprietary rights of ADC.
  22.  
  23. LIMITED WARRANTY
  24. 4.  ADC hereby warrants that, for a period of thirty (30) days from the date of 
  25. delivery to the customer, the licensed software shall materially conform to the 
  26. performance defined in the pertinent documentation relating thereto (manual, 
  27. guides, and computer-aided instructions).  ADC does not warrant that the operation 
  28. of the licensed software will be uninterrupted or error-free.  Customers sole and 
  29. exclusive remedy for failure of the licensed software to materially conform to the 
  30. performance defined in the pertinent documentation is for customer to return the 
  31. licensed software to ADC and notify ADC in writing of such non-conformity within 
  32. thirty (30) days of delivery to customer.  ADC's sole obligation shall be, at their 
  33. option, upon inspection of the licensed software, to within a reasonable time, 
  34. determine whether the licensed software has been tampered with in a manner which 
  35. would have violated the software license agreement.  In such a case, ADC will 
  36. terminate the software agreement and notify customer of such in writing within 
  37. (60) days.  If the licensed software is defective, ADC will provide the customer 
  38. with another copy of the licensed software, and the warranty period will begin upon 
  39. delivery of the replaced licensed software to the customer.

  41. DISCLAIMER OF OTHER WARRANTIES
  42. 5.  The express limited warranty set forth above is in lieu of any other express 
  43. warranties.  The implied warranty of merchantability is limited to the duration of 
  44. the express limited warranty .  ADC disclaims any implied warranty, including, but 
  45. not limited to, any implied warranty of fitness for a particular purpose and, for 
  46. periods after expiration of the express limited warranty, of merchantability.  ADC 
  47. further disclaims all warranties and representations made by persons other than 
  48. ADC including, but not limited to, distributors of any ADC software.
