  2. TITLE:    Organized Crime and Fraud 
  3. DEFINITIONS:    ñ 13-2301.  Definitions.

  5. E.  For the purposes of ñ 13.2316:
  6.  
  7. 1.  "Access" means to approach, instruct, communicate with, 
  8. store data in, retrieve data from or otherwise make use of 
  9. any resources of a computer, computer system or computer 
  10. network.  
  11.  
  12. 2.  "Computer" means an electronic device which performs 
  13. logic, arithmetic or memory functions by the manipulations 
  14. of electronic or magnetic impulses and includes all input, 
  15. output, processing, storage, software or communication 
  16. facilities which are connected or related to such a device 
  17. in a system or network.  
  18.  
  19. 3.  "Computer network" means the interconnection of 
  20. communication lines with a computer through remote terminals 
  21. or a complex consisting of two or more interconnected 
  22. computers.  
  23.  
  24. 4.  "Computer program" means a series of instructions or 
  25. statements, in a form acceptable to a computer, which 
  26. permits the functioning of a computer system in a manner 
  27. designed to provide appropriate products from such computer 
  28. system.  
  29.  
  30. 5.  "Computer software" means a set of computer programs, 
  31. procedures and associated documentation concerned with the 
  32. operation of a computer system.  
  33.  
  34. 6.  "Computer system" means a set of related, connected or 
  35. unconnected computer equipment, devices and software.  
  36.  
  37. 7.  "Financial instrument" means any check, draft, money 
  38. order, certificate of deposit, letter of credit, bill of 
  39. exchange, credit card or marketable security or any other 
  40. written instrument, as defined by ñ 13-2001, paragraph 7, 
  41. which is transferable for value.  
  42.  
  43. 8.  "Property" means financial instruments, information, 
  44. including electronically produced data, computer software 
  45. and programs in either machine or human readable form, and 
  46. anything of value, tangible or intangible.  
  47.  
  48. 9.  "Services" includes computer time, data processing and 
  49. storage functions.

  53. A.  A person commits computer fraud in the first degree by 
  54. accessing, altering, damaging or destroying without 
  55. authorization any computer, computer system, computer 
  56. network, or any part of such computer, system or network, 
  57. with the intent to devise or execute any scheme or artifice 
  58. to defraud or deceive, or control property or services by 
  59. means of false or fraudulent pretenses, representations or 
  60. promises.

  62. B.  A person commits computer fraud in the second degree by 
  63. intentionally and without authorization accessing, altering, 
  64. damaging or destroying any computer, computer system or 
  65. computer network or any computer software, program or data 
  66. contained in such computer, computer system or computer 
  67. network.

  70. C. Computer fraud in the first degree is a class 3 felony.  
  71. Computer fraud in the second degree is a class 6 felony.
