  1. BEFORE USING THIS PACKAGE, YOU SHOULD CAREFULLY READ THE FOLLOWING
  2. TERMS AND CONDITIONS. IF YOU USE THIS PROGRAM YOU AGREE TO THESE
  3. TERMS.  IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY
  4. RETURN THE PACKAGE TO IBM.

  6. IBM 32 Bit Textmode APIs for OS/2 2.1 Alpha (herein referred to as
  7. Kit).
  8.  
  9. GRANT OF LICENSE:
  10.  
  11. International Business Machines Corporation, or the applicable IBM
  12. country organization, grants you a non-transferable license to use
  13. use one copy of the Kit (what is comprised of object code, headers,
  14. and documentation contained on the diskette) on only one machine at
  15. any one time solely for testing and development feedback within your
  16. enterprise.  IBM further grants you the right to make an additional
  17. 9 copies of the Kit (for a total of 10 copies) to use under the
  18. provisions of this agreement.  Except as provided in this agreement,
  19. you may not copy, modify, merge, rent, lease, sell, sublicense, or
  20. assign or otherwise transfer this Kit.  You may not reverse compile
  21. or reverse assemble this Kit.  IBM owns, or has licensed from the
  22. owner, the copyrights in this Kit.

  24. TERM AND TERMINATION:

  26. Your license to the Kit terminations June 30, 1994.  Upon termination
  27. you agree to destroy all copies of the Kit.  You may terminate your
  28. license at any time by destroying all your copies of the Kit.  IBM
  29. may terminate your license if you fail to comply with the terms and
  30. conditions of this agreement.

  32. DISCLAIMER OF WARRANTY:

  34. The Kit contains pre-release code and may be modified substantially
  35. before general availability.  The Kit may not be at the level of
  36. performance or compatibility of generally available IBM products.
  37. IBM may not make the Kit generally available nor does IBM guarantee
  38. that the Kit will ever be made generally available.
  39.  
  40. The Kit is provided "as is" without any IBM warranties (or conditions),
  41. express or implied with respect to the Kit, including the implied
  42. warranties (or conditions) of merchantability and fitness for a
  43. particular purpose.  The entire risk arising out of the use or
  44. performance of the program and documentation remains with you.

  46. Some jurisdictions do not allow the exclusion or limitations for
  47. consequential or incidental damages, so the above may not apply to
  48. you.

  50. If you use the Kit in the United States, this license is governed
  51. by the laws of the State of New York.  If you use this Kit in
  52. Canada, this license is governed by the laws of the Province of
  53. Ontario. Otherwise, this license is governed by the laws of the
  54. country in which you use the Kit.
