  1. SpeedyNet License Agreement.
  2.  
  3. This is a legal agreement between you (either an individual
  4. or an entity) and Internet Wizards.  By installing this
  5. software, you indicate your acceptance of this License
  6. Agreement.
  7.  
  8. DEFINITIONS:
  9. Product - SpeedyNet
  10. Recipient - The user of this software.
  11.  
  12. INTERNET WIZARDS LICENSE AGREEMENT
  13.  
  14. 1. GRANT OF LICENSE.
  15.     (a) This product is SHAREWARE and is given on a trial
  16.     basis of 21 days. After this trial period, the
  17.     Recipient must either;
  18.                  a) Register the Product,
  19.                  b) Delete the Product.
  20.  
  21.     (b) Recipients shall not reverse engineer, decompile
  22.     or disassemble the Product except to the extent that
  23.     this restriction is expressly prohibited by
  24.     applicable law.  Internet Wizards and its suppliers
  25.     shall retain title and all ownership rights to the
  26.     Product.

  28.     (c) All material, written or published, are property
  29.     of Internet Wizards and remain copyright Internet
  30.     Wizards. No parts may be duplicated or altered
  31.     without permission, in writing, from Internet Wizards
  32.  
  33.     (d) Registration allows the perminant usage of the
  34.     product on ONE computer and only resident on ONE
  35.     computer.

  37. 2. TERM OF AGREEMENT.  
  38. The term of this Agreement shall commence on the
  39. Effective Date and shall continue until terminated upon
  40. the earlier of Internet Wizards's notice to Recipient.
  41.  
  42. 3. DISCLAIMER OF WARRANTY.  
  43. Product is deemed accepted by Recipient.  The PRODUCT
  44. is provided "AS IS" WITHOUT WARRANTY OF ANY KIND. TO
  45. THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW,
  46. INTERNET WIZARDS FURTHER DISCLAIMS ALL WARRANTIES,
  47. INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES
  48. OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  49. AND NONINFRINGEMENT.  THE ENTIRE RISK ARISING OUT OF
  50. THE USE OR PERFORMANCE OF THE PRODUCT AND
  51. DOCUMENTATION REMAINS WITH RECIPIENT. TO THE MAXIMUM
  52. EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
  53. INTERNET WIZARDS OR ITS SUPPLIERS BE LIABLE FOR ANY
  54. CONSEQUENTIAL, INCIDENTAL, DIRECT, INDIRECT, SPECIAL,
  55. PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING,
  56. WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  57. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  58. INFORMATION, OR OTHER PECUNIARY LOSS) ARISING OUT OF
  59. THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE
  60. PRODUCT, EVEN IF INTERNET WIZARDS HAS BEEN ADVISED
  61. OF THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE SOME
  62. STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
  63. LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR
  64. INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT
  65. APPLY TO RECIPIENT.

  67. 6. GOVERNING LAW; ATTORNEYS FEES.  
  68. If you acquired this Product in the United States, this
  69. Agreement shall be governed by the laws of the State of
  70. Washington.  If you acquired this Product outside the
  71. United States, local law may apply.  If either Internet
  72. Wizards or Recipient employs attorneys to enforce any
  73. rights arising out of or relating to this Agreement,
  74. the recipient shall be entitled to recover reasonable
  75. attorneys' fees.

  77. 7.  U.S. GOVERNMENT RESTRICTED RIGHTS.  
  78. The Product is provided with RESTRICTED RIGHTS.  Use,
  79. duplication, or disclosure by the Government is subject to
  80. restrictions as set forth in subparagraph (c)(1)(ii) of The
  81. Rights in Technical Data and Computer Software clause of
  82. DFARS 252.227-7013 or subparagraphs (c)(i) and (2) of the
  83. Commercial Computer Software -- Restricted Rights at
  84. 48 CFR 52.227-19, as applicable.  Manufacturer is Internet
  85. Wizards, 1/115 Bridgewater Rd, Craigieburn, Victoria,
  86. Australia, 3064

  88. 8. EXPORT RESTRICTIONS.  
  89. Recipient agrees that it will not export or re-export Product
  90. to any country, person, entity or end-user subject to U.S.
  91. export restrictions.  Recipient specifically agrees not to
  92. export or re-export Product (i) to any country to which the U.S.
  93. has embargoed or restricted the export of good or services, 
  94. which currently include, but are not necessarily limited to
  95. Cuba, Iran, Iraq, Libya, North Korea, Sudan and Syria, or to
  96. any national of any such country, wherever located, who intends
  97. to transmit or transport the Product back to such country, (ii)
  98. to any end-user who Recipient knows or has reason to know 
  99. will utilize Product in the design, development or production of
  100. nuclear, chemical or biological weapons, or (iii) to any end-user
  101. who has been prohibited from participating in U. S. export
  102. transactions by any federal agency of the U.S. government.
