  1. DYNAMIC SPELLING BEE - PRODUCT LICENSE INFORMATION
  2.  
  3. NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT. USE OF 
  4. THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") 
  5. CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS. IF YOU DO NOT AGREE TO 
  6. THE TERMS OF THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS SOFTWARE. 
  7. USER'S USE OF THIS SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER 
  8. WITH THE TERMS OF THIS AGREEMENT.
  9. 1. LICENSE GRANT.  Peter Richards grants you a license to use one 
  10. copy of the version of this SOFTWARE on any one hardware product for 
  11. as many licenses as you purchase.  "You" means the company, entity or 
  12. individual whose funds are used to pay the license fee.  "Use" means 
  13. storing, loading, installing, executing or displaying the SOFTWARE. 
  14. You may not modify the SOFTWARE or disable any licensing or control 
  15. features of the SOFTWARE except as an intended part of the SOFTWAREs 
  16. programming features.  When you first obtain a copy of the SOFTWARE, 
  17. you are granted an evaluation period of not more than 30 days, after 
  18. which time you must pay for the SOFTWARE according to the terms and 
  19. prices discussed in the SOFTWAREs documentation, or you must remove 
  20. the SOFTWARE from your computer.  This license is not transferrable 
  21. to any other hardware product or other company, entity, or individual.
  22. 2. OWNERSHIP.  The SOFTWARE is owned and copyrighted by Peter Richards.
  23. Your license confers no title or ownership in the SOFTWARE and should 
  24. not be construed as a sale of any right in the SOFTWARE.
  25. 3. COPYRIGHT.  The SOFTWARE is protected by English copyright law,1988, 
  26. United States copyright law and international treaty provisions. 
  27. You acknowledge that no title to the intellectual property in the 
  28. SOFTWARE is transferred to you.  You further acknowledge that title and 
  29. full ownership rights to the SOFTWARE will remain the exclusive property 
  30. of Peter Richards and you will not acquire any rights to the SOFTWARE 
  31. except as expressly set forth in this license. You agree that any copies 
  32. of the SOFTWARE will contain the same  proprietary notices which appear 
  33. on and in the SOFTWARE.
  34. 4. REVERSE ENGINEERING. You agree that you will not attempt to reverse 
  35. compile, modify, translate, or disassemble the SOFTWARE in whole or in 
  36. part.
  37. 5. NO OTHER WARRANTIES.  Peter Richards DOES NOT WARRANT THAT THE 
  38. SOFTWARE IS ERROR FREE. Peter Richards DISCLAIMS ALL OTHER WARRANTIES 
  39. WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT 
  40. NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A 
  41. PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.  SOME 
  42. JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR 
  43. LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION 
  44. OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE 
  45. LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES 
  46. YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY 
  47. FROM JURISDICTION TO JURISDICTION. 
  48. 6. SEVERABILITY.  In the event of invalidity of any provision of this 
  49. license, the parties agree that such invalidity shall not affect the 
  50. validity of the remaining portions of this license.  
  51. 7. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL Peter 
  52. Richards OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, 
  53. SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF 
  54. THE DELIVERY, PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF Peter 
  55. Richards HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO 
  56. EVENT WILL Peter Richards LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, 
  57. TORT OR ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY 
  58. YOU, IF ANY.
  59. 8. GOVERNING LAW.  This license will be governed by the laws of the 
  60. United Kingdom. The United Nations Convention on Contracts for the 
  61. International Sale of Goods is specifically disclaimed.
  62. 9. ENTIRE AGREEMENT.  This is the entire agreement between you and 
  63. Peter Richards which supersedes any prior agreement or understanding, 
  64. whether written or oral, relating to the subject matter of this license.
