  16. NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL AGREEMENT.  USE OF
  17. THE SOFTWARE PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") CONSTITUTES
  18. YOUR ACCEPTANCE OF THESE TERMS.  IF YOU DO NOT AGREE TO THE TERMS OF
  19. THIS AGREEMENT, DO NOT INSTALL AND/OR USE THIS SOFTWARE.  USER'S USE OF
  20. THIS SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH THE TERMS OF
  21. THIS AGREEMENT.

  23. 1.  LICENSE GRANT.  Creative Adept grants you a license to use one
  24.   copy of the version of this SOFTWARE on any one system for as many
  25.   licenses as you purchase.  "You" means the company, entity or
  26.   individual whose funds are used to pay the license fee.  "Use" means
  27.   storing, loading, installing, executing or displaying the SOFTWARE.
  28.   You may not modify the SOFTWARE or disable any licensing or control
  29.   features of the SOFTWARE except as an intended part of the SOFTWARE's
  30.   programming features.
  31.     When you first obtain a copy of the SOFTWARE, you are granted an
  32.   evaluation period of not more than 30 days, after which time you must
  33.   pay for the SOFTWARE according to the terms and prices discussed in the
  34.   SOFTWARE's documentation, or you must remove the SOFTWARE from your
  35.   system.  This license is not transferable to any other system, or to
  36.   another organization or individual.  You are expected to use the
  37.   SOFTWARE on your system and to thoroughly evaluate its usefulness and
  38.   functionality before making a purchase.  This "try before you buy"
  39.   approach is the ultimate guarantee that the SOFTWARE will perform to
  40.   your satisfaction; therefore, you understand and agree that there is
  41.   no refund policy for any purchase of the SOFTWARE.

  43. 2.  OWNERSHIP.  The SOFTWARE is owned and copyrighted by Creative
  44.   Adept.  Your license confers no title or ownership in the SOFTWARE
  45.   and should not be construed as a sale of any right in the SOFTWARE.

  47. 3.  COPYRIGHT.  The SOFTWARE is protected by United States copyright law
  48.   and international treaty provisions. You acknowledge that no title to
  49.   the intellectual property in the SOFTWARE is transferred to you.  You
  50.   further acknowledge that title and full ownership rights to the
  51.   SOFTWARE will remain the exclusive property of Creative Adept and
  52.   you will not acquire any rights to the SOFTWARE except as expressly set
  53.   forth in this license. You agree that any copies of the SOFTWARE will
  54.   contain the same proprietary notices which appear on and in the
  55.   SOFTWARE.

  57. 4.  REVERSE ENGINEERING. You agree that you will not attempt to reverse
  58.   compile, modify, translate, or disassemble the SOFTWARE in whole or in
  59.   part.

  61. 5.  NO OTHER WARRANTIES.  CREATIVE ADEPT DOES NOT WARRANT THAT THE
  62.   SOFTWARE IS ERROR FREE.  CREATIVE ADEPT DISCLAIMS ALL OTHER WARRANTIES
  63.   WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT
  64.   NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
  65.   PARTICULAR PURPOSE AND NONINFRINGEMENT OF THIRD PARTY RIGHTS.  SOME
  66.   JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR
  67.   LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION
  68.   OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE
  69.   LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES
  70.   YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH
  71.   VARY FROM JURISDICTION TO JURISDICTION.

  73. 6.  SEVERABILITY.  In the event of invalidity of any provision of this
  74.   license, the parties agree that such invalidity shall not affect the
  75.   validity of the remaining portions of this license.

  77. 7.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  IN NO EVENT SHALL CREATIVE
  78.   ADEPT OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, SPECIAL,
  79.   INCIDENTAL OR INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY,
  80.   PERFORMANCE OR USE OF THE SOFTWARE, EVEN IF CREATIVE ADEPT HAS BEEN
  81.   ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CREATIVE
  82.   ADEPT'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT OR ANY OTHER
  83.   THEORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.

  85. 8.  GOVERNING LAW.  This license will be governed by the laws of the
  86.   State of Utah as they are applied to agreements between Utah residents
  87.   entered into and to be performed entirely within Utah.  The United
  88.   Nations Convention on Contracts for the International Sale of Goods is
  89.   specifically disclaimed.

  91. 9.  ENTIRE AGREEMENT.  This is the entire agreement between you and
  92.   Creative Adept which supersedes any prior agreement or understanding,
  93.   whether written or oral, relating to the subject matter of this
  94.   license.
