Your rights to use Uninstaller are limited by the terms and conditions of the License Agreement below. The permission of CyberMedia to install the Uninstaller software is expressly conditioned on your reading and agreeing to the License Agreement in its entirety before installation:
This CyberMedia Uninstaller License Agreement ("Agreement") is a legal agreement between you and CyberMedia for the use of the CyberMedia Uninstaller Software and related documentation ("Software"), Uninstaller Knowledge Base ("Content") and the CyberMedia Uninstaller Service ("Service") comprising updates to the Software and the Content delivered in the course of using the Software.
LICENSE TERMS: Subject to your compliance with the terms of this agreement, CyberMedia grants to you a personal, non-exclusive and non-transferable license to install and use the Uninstaller Software and Uninstaller Content, together referred to as the "Product" in this agreement. The Uninstaller Product may also be used for the purpose of using the Uninstaller Service.
The Product may be installed only on a single computer used by you. The Uninstaller Content may be accessed only using the Uninstaller Software. You may also store a copy of the Product on a network server, provided it is used only to install or run the Product on a single computer over an internal network; you must acquire and dedicate a license for each separate computer on which the Product is installed or run from the network server.
LIMITS OF UNINSTALLER SERVICE: This version of Uninstaller will provide you with full functionality for a pre-determined period 14 days after first installed. After that time this version will refuse to operate and offer to remove itself from the system. CyberMedia is the sole determinant of how many days this version of Uninstaller will operate.
UNINSTALLER SERVICE LICENSE TERM: This agreement and the license granted in it for accessing the Uninstaller Service shall continue for a period of one year from the date of first installation on a computer. Unless renewed at or before the end of the license period, you agree not to access the Service after the termination of the license.
CyberMedia reserves the right to make any updates to the Uninstaller Software and Content available to you through alternative modes of access not requiring the use of the Uninstaller Software.
COPYRIGHT: All title and copyrights in and to the Software, including but not limited to any images, animations, music or text, and any accompanying material are owned by CyberMedia or its suppliers and is protected by copyright and other intellectual property rights laws and international treaties. Any Content provided with and during the course of use of the Uninstaller Service is also owned by CyberMedia or its suppliers. You agree to use the Content only together with the Software. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate the Content in any form to anyone, including but not limited to others in the same company or organization or to newsgroups, mail lists or electronic bulletin boards, without the express prior written consent of CyberMedia. You may not reverse engineer, decompile, or disassemble the Product. The Product is licensed as a single product. You may not separate its components for use on more than one computer.
USER OBLIGATIONS AND RESTRICTIONS. You are responsible for obtaining and maintaining at your own expense all telephone or other communications links, computer hardware and other equipment or facilities, Internet services needed for access to and use of the Product and the Service.
The Product may be used for your personal use only. All other uses including commercial use are prohibited.
NO WARRANTIES OR LIABILITIES: The Uninstaller Software is provided AS IS. You expressly acknowledge and agree that use of the Software is at your own risk and that the Software is provided without any warranties whatsoever.
The Uninstaller Content is also provided AS IS. As delivered in the course of using the Uninstaller Service and used by the Software, the Content is provided without any warranties whatsoever. Due to the inherent dynamic nature of the software industry from which the Content is selected and organized, there may be inaccuracies, omissions or delays in the delivery of Content.
SERVICE INTERRUPTIONS: The Uninstaller Service may be interrupted during the term of the license for reasons of planned or unplanned maintenance of its servers. In all cases, CyberMedia's obligations will be limited to making reasonable efforts to bring the servers back into operation. In no case shall CyberMedia be responsible for incidental or consequential damages resulting from Service interruptions.
You may also experience service interruptions, including service degradations, due to failures of your own Internet service provider or the failures of other service providers providing connectivity between your computer and the CyberMedia servers. CyberMedia disclaims all responsibility for service interruptions resulting from the failures of Internet service providers.
U.S. GOVERNMENT RESTRICTED RIGHTS: Use, duplication or disclosure by the Government is subject to the restrictions as set forth in subparagraph (c) (1) (ii) of the Right in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraph (c) (1) and (2) of the Commercial Computer Software -- Restricted Rights 48 CFR 52.227-19, as applicable. CHANGES TO AGREEMENT: CyberMedia may anytime and at its sole discretion, change or discontinue any aspect or feature of the Software or Content. CyberMedia shall have the right at any time to change the terms of this agreement or require new terms. Such changes shall be effective immediately upon distribution by any means which give you actual knowledge of them, and any use by you of the Product after such notice shall be deemed acceptance of them by you.
GOVERNING LAW: This agreement will be governed by the laws of the State of Delaware.
ENTIRE AGREEMENT: This agreement is the entire agreement between CyberMedia and you and supersedes any other License Agreements for the use of the Uninstaller Software, Content or Service. If any provision of this agreement is held invalid, the remainder of this agreement shall continue in full force and effect.
