  1. EASTMAN  KODAK  COMPANY
  2. SOFTWARE  LICENSE  AGREEMENT
  3. KODAK  DIGITAL  SCIENCE  PHOTO  INSERT  SOFTWARE

  5. LICENSE
  6.  
  7. 1.  Grant of License.  Eastman Kodak Company ("Kodak") grants you a license to use the enclosed 
  8. software program (the "Software") subject to the license restrictions set forth below.
  9.  
  10. 2.  Copyright.  The Software is owned by Kodak or its suppliers and protected by copyright laws and 
  11. international treaties.  You may copy the Software as necessary to enable you to use the Software.  You 
  12. may not reverse engineer, decompile, or disassemble the Software.
  13.  
  14. 3.  Term.  This license is effective until terminated.  You may terminate it at any time by destroying all 
  15. copies of the Software.  It will also terminate if you fail to comply with any term or condition of this 
  16. Agreement.  You agree upon such termination to destroy all copies of the Software.

  18. 4.  Limited License to Replicate.  If this Software was delivered to you by an authorized licensee of 
  19. Kodak on compact disc media (i.e. either a Photo CD disc or other CD-R (CD Recordable) or  CD-
  20. ROM (XA) disc) (hereafter referred to as the "Source Disc"), you have additional limited rights, as 
  21. described below, to copy this Software when making copies of the Source Disc.  Kodak grants you a 
  22. license to copy this Software from the Source Disc onto other Photo CD discs, CD-R discs or CD-
  23. ROM discs (the "Target Discs"), and to distribute those Target Discs, provided that (i) you have first 
  24. obtained all necessary rights to copy all of the other contents of the Source Disc, (ii) every Target Disc 
  25. you create contains a copy of the entire contents of the Source Disc, and (iii) you distribute a copy of 
  26. this software license agreement, in either electronic or printed form, with every Target Disc you 
  27. distribute.

  29. LIMITED WARRANTY
  30.  
  31. The Software is warranted "AS IS".  Kodak does not warrant that the functions contained in the 
  32. Software will meet your requirements or that the operation of the Software will be uninterrupted or 
  33. error free.  You assume responsibility for operation of the Software to achieve your intended results, 
  34. and for the installation, use, and results obtained from the Software.

  36. Subject to any applicable legislation which prohibits the following exclusions, KODAK MAKES NO 
  37. OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING 
  38. THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A 
  39. PARTICULAR PURPOSE.  Some states and countries, including Australia, do not allow the 
  40. exclusion of implied warranties, or have legislation that imposes certain statutory warranties that 
  41. cannot be excluded, so the above exclusion may not apply to you.  This warranty gives you specific 
  42. legal rights and you may also have other rights.

  46. LIMITATIONS OF REMEDIES

  48. IN NO EVENT WILL KODAK OR ITS SUPPLIERS OR DEALERS BE LIABLE TO YOU FOR 
  49. ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ANY LOST PROFITS, 
  50. LOST SAVINGS, OR OTHER DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE 
  51. THE SOFTWARE EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  Some 
  52. states and countries, including Australia, do not allow the limitation or exclusion of liability for 
  53. incidental or consequential damages, or have legislation which restricts the limitation or exclusion of 
  54. liability, so the above limitation may not apply to you.

  56. GENERAL
  57.  
  58. If the Software was purchased in the United States, this Agreement is governed by the laws of the State 
  59. of New York.  If purchased outside the United States, this Agreement is governed by the laws of the 
  60. country in which it was purchased.

  62. U.S. GOVERNMENT RESTRICTED RIGHTS
  63.  
  64. The Software and documentation are provided with RESTRICTED RIGHTS.  Use, duplication, or 
  65. disclosure by the Government is subject to restrictions as set forth in federal acquisition regulations 
  66. FAR/DFARS 52.227.14, 52.227-19, or 52.227-7013, as applicable.  Contractor/manufacturer is 
  67. Eastman Kodak Company, 343 State Street, Rochester, New York, 14650.

  69. EUROPEAN COMMUNITY PROVISIONS
  70.  
  71. If this Software is used within a country of the European Union, nothing in this Agreement shall be 
  72. construed as restricting any rights available under the European Community Software Directive 
  73. (91/250/EEC).
