  19. ■ PRESIDENT-ELECT CLINTON SAYS HE'LL END THE MILITARY'S BAN ON GAYS --

  22.   LITTLE ROCK, Ark. (EP) -- Gay activists who believed Bill Clinton 
  23.   would end the military's ban on homosexuality with a magic wave of his
  24.   "executive order" wand during his first 100 days in office are bracing
  25.   themselves for disappointment. Clinton has reaffirmed his commitment to
  26.   ending the ban on gays in military service. But he has backpedaled a bit
  27.   -- partly in response to almost unanimous opposition to the idea from
  28.   congressional and military leaders -- and now says he'll form a
  29.   committee to study the problem.

  31.   In a Veterans Day address in Little Rock, the president-elect said, "How 
  32.   to do it, the mechanics of doing it, I want to consult with military
  33.   leaders about that. There will be time to do that. My position is we
  34.   need everybody in America that's got a contribution to make, that's
  35.   willing to obey the law and work hard and play by the rules."

  37.   On Nov. 16, Clinton expanded on his remarks, saying, "On the issue of 
  38.   gays in the military, I've made no decision on a timetable except I want 
  39.   to firmly proceed ... after consulting with military leaders."

  41.   Gen. Colin Powell, chairman of the Joint Chiefs of Staff, and the 
  42.   highest-ranking black man in U.S. military history, has said that 
  43.   removing the ban on gays "would be prejudicial to good order and 
  44.   discipline."

  46.   Military leaders say that open displays of homosexuality in the military 
  47.   would undermine morale and discipline, and open a Pandora's box of 
  48.   sexual harassment actions. They also note that sharing barracks, 
  49.   showers, and latrines -- especially in combat or at sea -- could pose 
  50.   overwhelming logistical problems.

  52.   "It is difficult in a military setting where there is no privacy, where 
  53.   you don't get choice of association, where you don't get choice of where 
  54.   you live, to introduce a group of individual who are proud, brave, 
  55.   loyal, good Americans, but who favor a homosexual lifestyle," Powell 
  56.   told the House Budget Committee earlier this year.

  58.   Senate Armed Services Committee Chairman Sam Nunn (D-Ga.), considered a 
  59.   top candidate for the job of Defense Secretary, sid on CBS-TV's "Face 
  60.   the Nation" that he favors the current policy. "We've got to consider 
  61.   not only the rights of homosexuals but also the rights of those who are 
  62.   not homosexual and who give up a great deal of their privacy when they 
  63.   go in the military," he said.

  65.   If the change is to be made, Nunn added, it shouldn't happen in the 
  66.   first 100 days. "I think it ought to be studied as much as necessary to 
  67.   make sure that when he does implement it, we know exactly what we're 
  68.   doing and the military is fully prepared for it, and you don't have, for 
  69.   instance, violence against homosexuals," he said.

  71.   Clinton could lift the ban on homosexuals in the military through an 
  72.   executive order, but the rules against homosexual conduct spelled out in 
  73.   the Uniform Code of Military Justice can't be changed without an act of 
  74.   Congress. "I'd be surprised if he won that vote," said Senate Minority 
  75.   Leader Robert Dole (R-Kan.), who warned that quick action on the ban 
  76.   would cause Clinton "more trouble than he can add up right now. ...It 
  77.   will cause real problems with the military."

  79.   In a related story, a sailor who was drummed out of the Navy after 
  80.   revealing that he was a homosexual got his job back Nov. 12 under court 
  81.   order. Petty Officer First Class Keith Meinhold, who teaches sonar crews 
  82.   to hunt submarines, sued for reinstatement after being dismissed, and a 
  83.   U.S. District Court judge ordered the Navy to give him his old job until 
  84.   the case is settled. A Nov. 16 effort by the Navy to reverse the judge's 
  85.   decision was ineffective, and Meinhold is back on duty. Judge Terry 
  86.   Hatter hinted that he dislikes the ban on gays, and suggested that the 
  87.   Defense Department, "listening to the President-elect," should "put 
  88.   everything on hold" and stop discharging homosexuals until Clinton has
  89.   acted on the issue.

  91.   The military has dismissed more than 17,000 homosexuals in the past
  92.   decade to enforce its policy.
