  8. employees or agents be responsible to the purchaser for any consequential,
  9. incidental, or indirect damages (including damages for loss of business profits,
  10. business interruption, loss of business information and the like) arising out of
  11. the use or inability to use the C.A.K.E. Software product, even if C.A.K.E.
  12. Software has been advised of the possibility of such damages. Because some states
  13. do not allow the exclusion or limitation of liability for consequential or
  14. incidental damages, the above limitations may not apply to you.
