  129. using the SOFTWARE. "Use" means storing, loading, installing,
  130. executing, or displaying the SOFTWARE. You may not modify the
  131. SOFTWARE or disable any licensing or control features of the
  132. SOFTWARE except as an intended part of the SOFTWARE's
  133. programming features. If you choose to enable the trial
  134. features, you are granted an evaluation period of not more
  135. than 30 days, after which time you may not use those features
  136. unless you purchase the commercial version of the SOFTWARE, or
  137. you must remove the SOFTWARE from your computer. This license
  138. is not transferable to any other hardware product or other
  139. company, entity, or individual.

  142. 2. OWNERSHIP. The SOFTWARE is owned and copyrighted by Fookes
  143. Software. Your license confers no title or ownership in the
  144. SOFTWARE and should not be construed as a sale of any right in
  145. the SOFTWARE.

  148. 3. COPYRIGHT. The SOFTWARE is protected by United States
  149. copyright law and international treaty provisions. You
  150. acknowledge that no title to the intellectual property in the
  151. SOFTWARE is transferred to you. You further acknowledge that

  153. the exclusive property of Fookes Software and you will not
  154. acquire any rights to the SOFTWARE except as expressly set
  155. forth in this license. You agree that any copies of the
  156. SOFTWARE will contain the same proprietary notices which
  157. appear on and in the SOFTWARE.

  160. 4. UNAUTHORIZED USE. You may not use, copy, rent, lease, sell,
  161. modify, decompile, disassemble, otherwise reverse engineer, or

  164. automatic termination of this license.

  167. 5. BUNDLING. In no case may the SOFTWARE be bundled with
  168. hardware or other non-shareware software without written
  169. permission from Fookes Software (av. EugΦne-Pittard 22 ter,

  173. 6. DISTRIBUTION. Provided that you verify that you are
  174. distributing the Freeware or trial version of the SOFTWARE
  175. (you can see this information in the window title bar when you
  176. run the software: program name should be "NoteTab Light" or
  177. "NoteTab Pro trial") you are hereby licensed to make as many
  178. copies of the Freeware/trial package of the SOFTWARE as you
  179. wish; give exact copies of the original Freeware/trial package
  180. of the SOFTWARE to anyone; and distribute the Freeware/trial
  181. package of the SOFTWARE in its unmodified form via electronic
  182. means (Internet, BBS's, Shareware distribution libraries, CD-
  183. ROMs, etc.). You may charge a distribution fee for the
  184. package, but you must not represent in any way that you are
  185. selling the software itself.

  188. Freeware) is forbidden.

  204. disclosure by the U.S. Government of the computer software and

  216. LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR
  217. FITNESS FOR A PARTICULAR PURPOSE. NEITHER FOOKES SOFTWARE NOR
  218. ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION,
  219. OR DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT,
  220. CONSEQUENTIAL, OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR
  221. INABILITY TO USE SUCH SOFTWARE, EVEN IF FOOKES SOFTWARE HAS
  222. BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR CLAIMS. THE

  235. 9. SEVERABILITY. In the event of invalidity of any provision
  236. of this license, the parties agree that such invalidity shall
  237. not affect the validity of the remaining portions of this
  238. license.

  241. 10. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL
  242. FOOKES SOFTWARE OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY
  243. CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OF ANY
  244. KIND ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF THE
  245. SOFTWARE, EVEN IF FOOKES SOFTWARE HAS BEEN ADVISED OF THE
  246. POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL FOOKES
  247. SOFTWARE'S LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT,

  252. 11. GOVERNING LAW. This agreement shall be governed by the
  253. laws of Switzerland, excluding the application of its conflicts
  254. of law rules, and shall inure to the benefit of Fookes Software
  255. and any successors, administrators, heirs, and assigns. Any
  256. action or proceeding brought by either party against the other
  257. arising out of or related to this agreement shall be brought
  258. only in a COURT of competent jurisdiction located in
  259. Switzerland. The parties hereby consent to in personam
  260. jurisdiction of said courts. The United Nations Convention on
  261. Contracts for the International Sale of Goods is specifically
  262. disclaimed.

  265. 12. INSPECTION AND TESTING. You agree and acknowledge that you
  266. will thoroughly inspect and test the SOFTWARE for all of your
  267. purposes upon commencement of your use. Any suit or other
  268. legal action, claim, or any arbitration relating in any way to
  269. this agreement or software covered by it must be officially
  270. filed or officially commenced no later than 90 days after your
  271. first use of the software.

  274. 13. ENTIRE AGREEMENT. This is the entire agreement between you
  275. and Fookes Software, which supersedes any prior agreement or
  276. understanding, whether written or oral, relating to the
