  1. YAMAHA S-YXG50 trial version License Agreement

  3. BEFORE YOU USE THIS SOFTWARE, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS
  4. AGREEMENT. BY USING THIS SOFTWARE, YOU ARE CONSENTING TO BE BOUND BY AND ARE
  5. BECOMING A PARTY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF
  6. THIS AGREEMENT, DO NOT USE THE SOFTWARE.

  8.     1.YAMAHA Corporation ("YAMAHA") grants to you a non-exclusive, 
  9.       non-sublicensable, license to use the YAMAHA S-YXG50 trial version (the 
  10.       "Software"), in binary executabe form for evaluation and trial use 
  11.       purposes only. THIS SOFTWARE CONTAINS CODE THAT DISABLES MOST OF ITS 
  12.       FEATURES AFTER 90 DAYS FROM INSTALLATION.

  14.     2.YAMAHA MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SOFTWARE
  15.       OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SOFTWARE,
  16.       FOR ANY PURPOSE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR
  17.       IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS
  18.       FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED
  19.       GRATUITOUSLY AND, ACCORDINGLY, YAMAHA SHALL NOT BE LIABLE UNDER ANY
  20.       THEORY OR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SOFTWARE.
  21.       YAMAHA WILL NOT SUPPORT THIS SOFTWARE AND WILL NOT ISSUE UPDATES TO THIS
  22.       SOFTWARE.

  24.     3.All content accessed through the Software is the property of the applicabe
  25.       content owner and may be protected by applicable copyright law. This 
  26.       License gives you no rights o such content.

  28.     4.While YAMAHA intends to distribute a commercial release of the Software, 
  29.       YAMAHA reserves the right at any time not to release a commercial release
  30.       of the Software or, if released, to alter prices,features, specifications,
  31.       capabilities, functions, licensing terms, release dates, general 
  32.       availability or other characteristics of the commercial release.

  34.     5.Title, ownership rights, and intellectual property rights in and to the 
  35.       Software shall remain in YAMAHA. You agree to abide by the copyright law 
  36.       and all other applicable laws of Japan including,but not limited to,
  37.       export control laws. You acknowledge that the Software in source code 
  38.       form remains a confidential trade secret of YAMAHA and therefore you 
  39.       agree not to modify the Software or attempt todecipher,decompile, 
  40.       disassemble or reverse engineer the Software, except to the extent 
  41.       applicable laws specifically prohibit such restriction.

  43.     6.YAMAHA may terminate this License at any time by delivering notice to you
  44.       and you may terminate this License at any time by destroying or erasing 
  45.       your copy of the Software. Upon termination of this License, you agree to
  46.       destroy or erase the Software. In the event of termination, the following
  47.       sections of this License will survive: 2, 3, 4, 5, 6,and 7. This License
  48.       is personal to you and you agree not to assign your rights herein. This 
  49.       License shall be governed by and construed in accordance with the laws of
  50.       Japan and, as to matters affecting copyrights, trademarks and patents, by
  51.       Japanese law. This License sets forth the entire agreement between you and
  52.       YAMAHA.

  54.     7.YAMAHA SHALL NOT BE LIABLE FOR (a) INCIDENTAL,CONSEQUENTIAL,SPECIAL OR
  55.       INDIRECT DAMAGES OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR
  56.       OTHERWISE, EVEN IF YAMAHA HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH
  57.       DAMAGES, OR (b) FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF
  58.       LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE
  59.       EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE,SOME
  60.       STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR
  61.       CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO
