  1. OnMark 2000(tm) BIOS Test and Fix License Agreement
  2.  
  3. Carefully read the following terms and conditions which
  4. apply to your use of Viasoft's OnMark 2000 computer
  5. software programs, documentation and information (the
  6. "Software") prior to downloading.  By clicking the
  7. "Accept" icon below, you agree to accept these terms and
  8. conditions as they relate to your use of the Software.

  10. 1. You acknowledge that this is a license agreement 
  11.    ("License Agreement") and not a contract for sale of
  12.    the Software.  You are authorized to use the Software 
  13.    only on the personal computer onto which you download 
  14.    the Software. You may make one back-up copy of the 
  15.    Software.  You may not sub-license, lease, rent, sell, 
  16.    assign or in any way convey or distribute the Software 
  17.    to any third party.  In no event will you cause or 
  18.    permit the disassembly, reverse compilation or other 
  19.    decoding of the Software.  Any unauthorized use will be 
  20.    deemed to be an infringement.

  22. 2. All right, title and interest in the Software and in 
  23.    the trade marks and service are owned by Viasoft.  This 
  24.    License Agreement gives you no rights of any kind in or 
  25.    to use any of these trademarks or service marks except 
  26.    to refer to this Software.  This Software is protected 
  27.    by copyright and other proprietary rights.  This 
  28.    License Agreement gives you no rights in the Software 
  29.    under any of these laws.

  31. 3. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES 
  32.    CONCERNING THE SOFTWARE, EXPRESS, IMPLIED OR STATUTORY, 
  33.    ARE HEREBY EXPRESSLY DISCLAIMED AND EXCLUDED, 
  34.    INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF 
  35.    MERCHANTABILITY, TITLE, IMPLIED WARRANTY OF 
  36.    NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, OR 
  37.    INCREASED EFFICIENCY OF USE OF HARDWARE OR SOFTWARE 
  38.    COMPUTER SYSTEMS, DATA OR PROGRAMS.  VIASOFT SHALL NOT 
  39.    UNDER ANY CIRCUMSTANCE BE LIABLE TO YOU OR ANY OTHER 
  40.    PARTY FOR ANY DIRECT, SPECIAL, INDIRECT, OR 
  41.    CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT 
  42.    LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK 
  43.    STOPPAGE, LOST PROFITS, LOST DATA OR COMPUTER HARDWARE 
  44.    OR SOFTWARE DAMAGE, FAILURE OR MALFUNCTION.

  46. 4. You may not export, ship, transmit or re-export the 
  47.    Software or related documentation in violation of any 
  48.    applicable law or regulation.  None of the Software or 
  49.    underlying information or technology may be downloaded 
  50.    or otherwise exported or re-exported (i) into (or to a 
  51.    national or resident of)  Cuba, Iran, Iraq, Libya, 
  52.    North Korea, Sudan, or Syria, or any other country to 
  53.    which the U.S. has embargoed goods; or (ii) to anyone 
  54.    on the U.S. Treasury Department's list of Specially 
  55.    Designated Nationals or the U.S. Commerce Department's 
  56.    Table of Denial Orders. By downloading or using the 
  57.    Software you are agreeing to the foregoing and you are 
  58.    representing and warranting that you are not located 
  59.    in, under the control of, or a national or resident of 
  60.    any such country or on any such list.  In addition, you 
  61.    are responsible for complying with any local laws in 
  62.    your jurisdiction which may impact your right to 
  63.    import, export or use the Software.

  65. 5. This Software is not designed for use in high risk 
  66.    activities such as in the operation of nuclear 
  67.    facilities, aircraft communication or navigation, air 
  68.    traffic control, direct life support machines, or 
  69.    weapons systems.  Accordingly, Viasoft disclaims all 
  70.    express and implied warranties of fitness for high risk 
  71.    activities.

  73. 6. The validity, construction and performance of this 
  74.    License will be governed by and construed in accordance 
  75.    with the laws of the State of Arizona, USA.
