  6. The software, as defined below, is protected by copyright which 
  7. is vested in Microviet. Registration codes, as defined below, are 
  8. protected by copyright which is vested in Microviet. The software 
  9. and registration codes may only be used in accordance with the terms 
  10. and conditions set out in this document. If you do not read and 
  11. agree to be bound by the terms and conditions defined in this 
  12. document then you are not permitted to keep or use the software 
  13. or registration codes in any way whatsoever and must destroy or 
  14. return all copies of these items which are in your possession.

  16. Definitions

  18. The following definitions apply to the terms and conditions included 
  19. in this document.the software means all program and information files 
  20. and other documentation which are part of the Microviet package, with 
  21. the exception of license keys which are not part of the software. a 
  22. registration code is a code which is used to control the features 
  23. available in the software, but is not itself part of the software. 
  24. an individual means a particular person. a use of the software means 
  25. use of the software on one or more computers by a single individual. 
  26. Where the software is used by more than one person, then this will 
  27. constitute multiple uses where the number of uses will be equal to 
  28. the number of individuals able to access to the software even if not 
  29. all of the individuals with access make use of the software.

  32. SOFTWARE LICENCE AGREEMENT
  33. This is a legal agreement between you, the users, and Microviet. 
  34. By installing or using this software, you agree to be bound by the 
  35. terms of this agreement. If you do not agree to those terms, you may 
  36. not use or install Microviet products.

  38. You are welcome to evaluate for 30 user days. 
  39. Extended usage requires registration. We encourage you to register 
  40. Microviet products and support its further development. To purchase 
  41. the program, please use the contact address given below.
  42. You may use one copy of the software on only one computer at a time.
  43. If you have multiple licenses of  the software, you may use as many 
  44. copies at any time as you have a license. "Use" means loaded in 
  45. temporary memory or permanent storage on the computer. Installation on 
  46. a network server solely for distribution to other computers is not "use", 
  47. if you have a separate license for each computer to which the software 
  48. is distributed. If users will exceed the number of licenses, you must 
  49. have a reasonable process to assure that the number of persons using the 
  50. software concurrently does not exceed the number of licenses.

  52. The software is protected by United States copyright 
  53. laws and international treaties. You may make one copy of the software 
  54. solely for backup or archival purposes or transfer it to a single hard 
  55. disk provided you keep the original disk solely for backup or archival 
  56. purposes. You may not rent or lease the software or copy any written
  57. materials accompanying the software, but you may transfer the software 
  58. and all accompanying materials on a permanent basis, if you retain no 
  59. copies and the recipient agrees to the terms. Any transfer must include 
  60. the most recent update and all prior versions. You may not reverse engineer, 
  61. de-compile or disassemble the software.

  63. You expressly acknowledge and agree that use of Microviet products 
  64. is at your own risk and that Microviet products is provided "as is" 
  65. without any warranties or conditions whatsoever. Microviet does not warrant 
  66. that the functions of the software will meet your requirements or that the 
  67. Microviet productstion of the software will be uninterrupted or error 
  68. free. You assume responsibility for selecting the software to achieve y
  69. our intended results, and for the use and the results obtained from the 
  70. software.

  72. Microviet disclaims all warranties, express or implied, including but not 
  73. limited to implied warranties of merchantability and fitness for a particular 
  74. purpose, for the software and all accompanying written materials.

  76. In no event shall Microviet or its suppliers be liable for any damages 
  77. whatsoever (including, without limitation, damages for loss of business 
  78. profits, business interruption, loss of business information, or other 
  79. pecuniary loss) arising out of use or inability to use the software, even 
  80. if advised of the possibility of such damages.

  83. Copying and Distribution

  85. The software may be freely copied, stored and distributed by any person or 
  86. organization, providing that the person or organization meets the terms and 
  87. conditions of this document in full. Modification of the software, and storage, 
  88. distribution and copying of modifications to the software is prohibited.

  90. Registration codes may be used in conjunction with the software only by the 
  91. person or organization which purchased the associated product license. 
  92. Neither a license nor a registration code may be transferred from the 
  93. original end user purchaser to any third party.

  95. Registration codes are not part of the software and may be stored or 
  96. copied only by the person or organization which purchased the associated 
  97. license, and providing that the terms of the associated license are met in 
  98. full. Such storage or copying shall be permitted solely for the purpose of 
  99. using the software within the terms and conditions of this document. No 
  100. person or organization is permitted to store or copy a registration code 
  101. for any other purpose without written agreement from Microviet.

  103. The copyright of all registration codes remains vested in Microviet 
  104. which reserves the right to withhold or withdraw authorization of use 
  105. of all registration codes issued to a person or organization if there 
  106. is reasonable evidence to indicate that the person or organization is 
  107. involved in a breach of the terms of this document.

  112. Any variation to the terms of this document shall only be valid if 
  113. made in writing by Microviet.
