  1. YOU SHOULD CAREFULLY READ THE FOLLOWING END USER LICENSE AGREEMENT 
  2. BEFORE INSTALLING THIS SOFTWARE PROGRAM. BY INSTALLING, COPYING, OR 
  3. OTHERWISE USING THE SOFTWARE PROGRAM, YOU AGREE TO BE BOUND BY THE 
  4. TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS 
  5. AGREEMENT, PROMPTLY RETURN THE UNUSED SOFTWARE PROGRAM TO THE PLACE 
  6. FROM WHICH YOU OBTAINED IT FOR A FULL REFUND.

  8. This software program (the "Program"), any printed materials, any on-
  9. line or electronic documentation, and any and all copies and 
  10. derivative works of such software program and materials are the 
  11. copyrighted work of Martin Baltensperger. All use of the Program is governed 
  12. by the terms of the End User License Agreement which is provided below 
  13. ("License Agreement"). The Program is solely for use by end users 
  14. according to the terms of the License Agreement. Any use, reproduction 
  15. or redistribution of the Program not in accordance with the terms of 
  16. the License Agreement is expressly prohibited.

  19. END USER LICENSE AGREEMENT
  20.  
  21.    1. Limited Use License. Martin Baltensperger hereby 
  22. grants, and by installing the Program you thereby accept, a limited, 
  23. non-exclusive license and right to install and use one (1) copy of the 
  24. Program for your use on either a home or portable computer.  The
  25. Program is licensed, not sold. Your license confers no  title or
  26. ownership in the Program.

  28.    2. Ownership. All title, ownership rights and intellectual property 
  29. rights in and to the Program and any and all copies thereof (including 
  30. but not limited to any titles, computer code, themes, objects, 
  31. stories, dialog, catch phrases, locations, concepts, artwork, animations,
  32. sounds, musical compositions, audio-visual effects, methods of operation,
  33. moral rights, and any related documentation) are owned by Martin Baltensperger,
  34. except when otherwise stated.
  35. The Program is protected by international copyright treaties and
  36. conventions and other laws. All rights are reserved.

  38.    3. Responsibilities of End User.
  39.  
  40.       A. Subject to the Grant of License hereinabove, you may not, in 
  41. whole or in part, copy, photocopy, reproduce, translate, reverse 
  42. engineer, derive source code, modify, disassemble, decompile, create 
  43. derivative works based on the Program, or remove any proprietary 
  44. notices or labels on the Program without the prior consent, in 
  45. writing, of Martin Baltensperger.

  47.       B. The Program is licensed to you as a single product. Its 
  48. component parts may not be separated for use on more than one 
  49. computer. 
  50.  
  51.       C. You are entitled to use the Program for your own use, but you 
  52. are not be entitled to:
  53.  
  54.     (i) sell, grant a security interest in or transfer
  55.     reproductions of the Program to other parties in any way, nor 
  56.     to rent, lease or license the Program to others without the 
  57.     prior written consent of Martin Baltensperger.
  58.  
  59.     (ii) exploit the Program or any of its parts for any 
  60.     commercial purpose including, but not limited to, use at a 
  61.     cyber cafΘ, computer gaming center or any other location-
  62.     based site. Martin Baltensperger may offer a separate Site License 
  63.     Agreement to permit you to make the Program available for 
  64.     commercial use; contact him for details;
  65.  
  66.    4. Termination. This License Agreement is effective until 
  67. terminated. You may terminate the License Agreement at any time by 
  68. destroying the Program and any New Materials. Martin Baltensperger may,
  69. at his discretion, terminate this License Agreement in the event that
  70. you  fail to comply with the terms and conditions contained herein.
  71. In such  event, you must immediately destroy the Program and any New
  72. Materials.

  74.    5. Limited Warranty. Martin Baltensperger expressly disclaims any warranty for 
  75. the Program and Manual(s). The Program and Manual(s) 
  76. are provided "as is" without warranty of any kind, either express or 
  77. implied, including, without limitation, the implied warranties of 
  78. merchantability, fitness for a particular purpose, or noninfringement. 
  79. The entire risk arising out of use or performance of the Program and 
  80. Manual(s) remains with the User.

  82.    6. Limitation of Liability. Martin Baltensperger SHALL NOT BE
  83. LIABLE IN ANY WAY FOR LOSS OR DAMAGE OF ANY KIND RESULTING FROM THE 
  84. USE OF THE PROGRAM INCLUDING, BUT NOT LIMITED TO, LOSS OF 
  85. GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND 
  86. ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

  88.    7. Equitable Remedies. You hereby agree that Martin Baltensperger would be 
  89. irreparably damaged if the terms of this License Agreement were not 
  90. specifically enforced, and therefore you agree that Martin Baltensperger shall be 
  91. entitled, without bond, other security, or proof of damages, to 
  92. appropriate equitable remedies with respect to breaches of this 
  93. License Agreement, in addition to such other remedies as Martin Baltensperger
  94. may  otherwise have available to it under applicable laws.

  96. I hereby acknowledge that I have read and understand the foregoing 
  97. License Agreement and agree that the action of installing the Program 
  98. is an acknowledgment of my agreement to be bound by the terms and 
  99. conditions of the License Agreement contained herein. I also 
  100. acknowledge and agree that this License Agreement is the complete and 
  101. exclusive statement of the agreement between Martin Baltensperger and I and that 
  102. the License Agreement supersedes any prior or contemporaneous 
  103. agreement, either oral or written, and any other communications 
  104. between Martin Baltensperger and myself.
