  1. 以下は、Java 1.0.2 for OS/2およびJava for OS/2を実行するために必要な
  2. OS/2一部の修正「プログラム」のご使用条件です

  5. A) IBMプログラムのご使用条件- Java 1.0.2 for OS/2 
  6.  
  7.   「プログラム」を使用する前にこの使用条件をお読みください。IBMは、こ
  8.   の使用条件に同意された場合に限り、お客様に対して「プログラム」の使用権
  9.   を許諾します。「プログラム」の入手方法（電子的、初期導入、記録媒体また
  10.   はその他の方法）にかかわらず、お客様が「プログラム」を使用されると、以
  11.   下の条件に同意したものとみなします。

  13.   Ⅰ．使用権
  14.  
  15.    IBMは、このご使用条件（第Ⅶ条および第Ⅷ条の条件を含みます。）に基づき、
  16.   お客様に対して「プログラム」を一時点において一台の機械でのみ使用できる、
  17.   非独占的で移転不能、譲渡不能な使用権を許諾します。

  19.   お客様は、この使用条件に明記されている場合を除き、1)「プログラム」を
  20.   複製、変更もしくは改変すること、2) 「プログラム」を第三者に貸与、賃
  21.   貸、販売、再使用許諾、譲渡、配布、転送もしくはその他移転すること、また
  22.   は、3)法律の強行規定のある場合を除き、「プログラム」を逆コンパイル、
  23.   逆アセンブルもしくはその他翻案もしくは翻訳することはできません。

  25.   Ⅱ．著作権
  26.  
  27.   「プログラム」は、インターナショナル・ビジネス・マシーンズ・コーポレー
  28.   ション、その直接もしくは間接の子会社（以下合わせて「ＩＢＭ」といいま
  29.   す。）または「プログラム」の提供者が著作権を持ち、使用許諾するものであ
  30.   り、売買の対象とされるものではありません。お客様は、「プログラム」を予
  31.   備用として複製することができます。お客様は「プログラム」に表示されてい
  32.   るものと同一の著作権表示を必ず行うものとします。

  34.   Ⅲ．期間および解約
  35.  
  36.   お客様は、「プログラム」およびそのすべての複製物を破毀することにより、
  37.   いつでもこの使用契約を解約できます。また、お客様がこの使用条件に違反し
  38.   た場合には、IBMはこの使用契約を解約することができます。この場合、お
  39.   客様の使用権は消滅し、お客様は「プログラム」およびすべての複製物を破毀
  40.   するものとします。

  42.   Ⅳ．保証の内容と制限
  43.  
  44.   強行法規で除外を禁止されている場合を除き、IBMは、「プログラム」を特
  45.   定物として現存するままの状態で提供し、第三者の権利の不侵害の保証、商品
  46.   性の保証、特定目的適合性の保証または法律上の瑕疵担保責任を含むすべての
  47.   明示もしくは黙示の保証責任または保証条件を負わないものとします。この規
  48.   定は、IBMの従契約者、「プログラム」の提供者または開発者（以下合わせ
  49.   て「提供者」といいます。）に対しても適用されます。

  51.   Ⅴ．責任の制限
  52.  
  53.    IBMおよび「提供者」は、逸失利益、IBMまたは「提供者」の予見の有無を
  54.   問わず発生した付随的損害、特別損害およびその他の拡大損害を含む直接損害
  55.   または間接損害について責任を負いません。国または地域によっては、法律の
  56.   強行規定により、上記の責任の制限が適用されない場合があります。

  58.   Ⅵ．その他
  59.  
  60.   この使用契約には、お客様が「プログラム」を取得した国の法律が適用されま
  61.   す。ただし、お客様がこの「プログラム」を(1)オーストラリアで取得され
  62.   た場合には、取引の行われた州もしくは地域の法律が、(2)中央ヨーロッパ
  63.   諸国もしくはロシア共和国で取得された場合には、オーストリアの法律が、
  64.    (3エストニア、ラトビアもしくはリトアニアで取得された場合には、フィン
  65.   ランドの法律が、(4)カナダで取得された場合には、オンタリオ州の法律が、
  66.   または(5)アメリカ合衆国、プエルトリコもしくは中華人民共和国で取得さ
  67.   れた場合には、ニューヨーク州の法律が適用されます。「プログラム」を輸出
  68.   する場合、お客様は、該当する輸出入関連法規を含む、すべての関連法規を遵
  69.   守するものとします。この使用契約は、この取引に関する完全な合意文書であ
  70.   り、事前の両当事者間の口頭または書面による通知等を置き換えるものです。
  71.   この使用契約は、両当事者が記名押印した書面によってのみ変更できるものと
  72.   します。

  74.   Ⅶ．追加条件
  75.  
  76.    IBMは、別途有償のサービス契約を締結している場合を除き、「プログラム」
  77.   に対してプログラム・サービスまたはその他の技術的なサポートを提供いたし
  78.   ません。お客様が、サービス契約を締結している場合、この「プログラム」に
  79.   対するサポートの範囲および条件は、当該サービス契約に基づき定められるも
  80.   のとします。

  82.   お客様は、使用権を許諾されているOS/2とともに使用するために個々の使用
  83.   権に対応する「プログラム」の複製を行うことができます。この場合、お客様
  84.   は必ず「プログラム」に表示されているものと同一の著作権表示を行うものと
  85.   します。また、この「プログラム」の複製物に対しても、このご使用条件が適
  86.   用されます。

  89.   Ⅷ．各国固有の条件

  91.   本条記載の条件は、各前条の条件に優先します。

  99.   No Warranty (Section IV): The warranties specified in this Section are
  100.   in addition to any rights you may have under the Trade Practices Act or
  101.   other legislation and are limited only to the extent permitted by the
  102.   applicable legislation.

  104.   Limitation of Liability (Section V): The following paragraph is added to
  105.   this Section: Where IBM is in breach of a condition or warranty implied
  106.   by the Trade Practices Act 1974, IBM's liability is limited to: (a)
  107.   where IBM supplied services, the cost of having services supplied again;
  108.   or (b) where IBM supplied goods, the repair or replacement of the goods,
  109.   or the supply of equivalent goods. Where that condition or warranty
  110.   relates to right to sell, quiet possession or clear title, or the goods
  111.   are of a kind ordinarily acquired for personal, domestic or household
  112.   use or consumption, then none of the limitations in this paragraph
  113.   apply.

  115.   NEW ZEALAND:
  116.  
  117.   No Warranty (Section IV): The warranties specified in this Section are
  118.   in addition to any rights you may have under the Consumer Guarantees Act
  119.   1993 or other legislation which cannot be excluded or limited. The
  120.   Consumer Guarantees Act 1993 will not apply in respect of any goods or
  121.   services which we provide, if you require the goods and services for the
  122.   purposes of a business as defined in the Act.

  124.   Limitation of Liability (Section V): The following paragraph should be
  125.   added to this Section: Where products or services are not acquired for
  126.   the purposes of a business as defined in the Consumer Guarantees Act
  127.   1993, the limitations in the Section are subject to the limitations in
  128.   that Act.

  130.   GERMANY:
  131.  
  132.   No Warranty (Section IV): The warranty for any IBM Program covers the
  133.   functionality of the Program for its normal use. In case a Program is
  134.   delivered without specifications, IBM will only warrant that the Program
  135.   information correctly describes the Program and that the Program can be
  136.   used according to the Program information. The minimum warranty period
  137.   is six months.

  139.   Limitation of Liability (Section V): The limitations and exclusions
  140.   specified in the Agreement will not apply to damages caused by us with
  141.   intention or gross negligence. IBM is liable for assured
  142.   characteristics.

  144.   IRELAND:

  146.   No Warranty (Section IV): Except as expressly provided in these terms
  147.   and conditions, all statutory conditions, including warranties implied,
  148.   but without prejudice to the generality of the foregoing all warranties
  149.   implied by the Sale of Goods Act 1893 or the Sale of Goods and Supply of
  150.   Services Act 1980 are hereby excluded.

  152.   ITALY:

  154.   (Limitation of Liability (Section V): The clause is replaced by the
  155.   following: Unless otherwise provided by mandatory law, IBM is not liable
  156.   for any damages which might arise.

  158.   UNITED KINGDOM:

  160.   Limitation of Liability (Section V): Add the following paragraph at the
  161.   end of the first paragraph: The limitation of liability will not apply
  162.   to any breach of IBM's obligations implied by Section 12 of the Sales of
  163.   Goods Act 1979 or Section 2 of the Supply of Goods and Services Act
  164.   1982.

  172. B) Java 1.0.2 for OS/2のためのOS/2の一部の修正
  173.    「プログラム」に対するご使用条件

  175.   「プログラム」を使用する前にこの使用条件をお読みください。IBMは、こ
  176.   の使用条件に同意された場合に限り、お客様に対して「プログラム」の使用権
  177.   を許諾します。「プログラム」の入手方法（電子的、初期導入、記録媒体また
  178.   はその他の方法）にかかわらず、お客様が「プログラム」を使用されると、以
  179.   下の条件に同意したものとみなします。

  181. - お客様は、OS/2 Warp Version 3、OS/2 Warp Connect、OS/2 Warp 4、
  182.   またはOS/2 Warp Server(以下「OS/2製品」といいます。)
  183.   の有効な使用権を許諾されている場合に限り、この「プログラム」を使用す
  184.   ることができます。

  186. - お客様は、この「プログラム」を保守の目的でのみ使用するものとします。
  187.  
  188. - お客様は、使用権を許諾されている「OS/2製品」とともに使用するために
  189.   個々の使用権に対する「プログラム」の複製を行うことができます。
  190.  
  191. - この「プログラム」の複製物に対しても、お客様が取得された「OS/2製品」
  192.   に同梱の「IBMプログラムのご使用条件」が適用されます。ただし、この
  193.   「プログラム」の取得により、元の「OS/2製品」のプログラムの保証また
  194.   はサービスが拡張されることはありません。
