It's not a "touchy" issue unless it has involved nasty court battles.
Creating any product using the name "TORO" or anything close is a
"touchy" area; Toro has been known to file objections with the trademark
office over other filings and to sue in court. Nobody who knows marks
will touch anything using "Toro" without a large war chest, since Toro
will fight.
The correct term is that it's a gray area.
