Such a restriction (1) would not be binding upon an on-line service that
received the file; the person who _uploaded_ it is supposed to check and
not upload it, as *they* are the ones violating the restriction, even
assuming it was valid, and
(2) a restriction changing the terms to increase the burden for someone
charging as opposed to someone not charging MAY constitute a violation of
the antitrust laws.
Many people who put out software with cost restrictions are skating on
extremely thin ice legally, since the Sherman Act permits someone
creating an illegal restraint of trade to be sued for TRIPLE DAMAGES.
An innocent little restriction on transfers other than free could land
the person on the other side of a lawsuit themselves.
