  30. Such a restriction (1) would not be binding upon an on-line service that 
  31. received the file; the person who _uploaded_ it is supposed to check and 
  32. not upload it, as *they* are the ones violating the restriction, even 
  33. assuming it was valid, and
  34.  
  35. (2) a restriction changing the terms to increase the burden for someone 
  36. charging as opposed to someone not charging MAY constitute a violation of 
  37. the antitrust laws.

  39. Many people who put out software with cost restrictions are skating on 
  40. extremely thin ice legally, since the Sherman Act permits someone 
  41. creating an illegal restraint of trade to be sued for TRIPLE DAMAGES.
  42. An innocent little restriction on transfers other than free could land 
  43. the person on the other side of a lawsuit themselves.
