  2.        IBM PROGRAM LICENSE AGREEMENT FOR "JUST ADD OS/2 WARP"
  3.  
  4. IF YOU RECEIVED THE "JUST ADD OS/2 WARP" PACKAGE ON DISKETTES, THE
  5. FOLLOWING TERMS AND CONDITIONS APPLY TO THE DISKETTES AND ALL PROGRAMS AND
  6. DOCUMENTATION CONTAINED ON THE DISKETTES (HEREINAFTER COLLECTIVELY REFERRED
  7. TO AS THE "PROGRAM"). IF YOU RECEIVED THE "JUST ADD OS/2 WARP" PACKAGE
  8. ELECTRONICALLY, THE FOLLOWING TERMS AND CONDITIONS APPLY TO ALL PROGRAMS
  9. AND DOCUMENTATION YOU DOWNLOADED (HEREINAFTER COLLECTIVELY REFERRED TO AS
  10. THE "PROGRAM"). BEFORE YOU CONTINUE TO USE THE PROGRAM YOU SHOULD CAREFULLY
  11. READ THE FOLLOWING TERMS AND CONDITIONS.  CONTINUING TO USE THE PROGRAM
  12. INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT
  13. AGREE TO THESE TERMS AND CONDITIONS YOU MUST STOP USING THE PROGRAM AND
  14. EITHER:
  15.  
  16. 1. RETURN THE PROGRAM TO IBM,
  17. 2. TRANSFER THE PROGRAM, PROVIDED THE TRANSFEREE AGREES TO BE BOUND IN
  18.    ALL RESPECTS BY THIS LICENSE AGREEMENT, OR
  19. 3. DESTROY THE PROGRAM.

  21.      The PROGRAM is licensed not sold.  International Business Machines
  22. Corporation or the applicable IBM country organization (IBM) grants you a
  23. license for the PROGRAM only in the country where you acquired the PROGRAM.
  24. You obtain no rights other than those granted you under this license.
  25. IBM owns or has licensed from the owner copyrights in the PROGRAM.  You are
  26. responsible for the selection of the PROGRAM and for the installation of,
  27. use of, and results obtained from, the PROGRAM.

  29. 1. License
  30.  
  31.      Under this license, you may:
  32.  
  33.      1) use the PROGRAM on only one machine at any one time and
  34.      2) transfer the possession of the PROGRAM to another party.
  35.  
  36. If you transfer the PROGRAM, you must transfer your copy of the PROGRAM and
  37. a copy of this license to the other party. Your license is then terminated.
  38. The other party agrees to these terms and conditions by its first use of
  39. the PROGRAM.
  40.  
  41.      Under this license, you may not:
  42.  
  43.      1) use or transfer the PROGRAM except as provided in this license;
  44.      2) post the PROGRAM electronically;
  45.      2) copy, modify, merge, or distribute the PROGRAM;
  46.      3) reverse assemble or reverse compile the PROGRAM; or
  47.      4) sublicense, rent, lease, or assign the PROGRAM.

  49. 2. Warranty
  50.  
  51. THE PROGRAM IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES (CONDITIONS) OF ANY
  52. KIND.  IBM DISCLAIMS ALL WARRANTIES (CONDITIONS) FOR THE PROGRAM, EITHER
  53. EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES
  54. OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  56. Some jurisdictions do not allow exclusion of implied warranties, so the
  57. above exclusions may not apply to you.
  58.  
  59. 3. Limitation of Remedies
  60.  
  61. IN NO EVENT WILL IBM BE LIABLE FOR ANY LOST PROFITS, LOST SAVINGS,
  62. INCIDENTAL OR INDIRECT DAMAGES OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES,
  63. EVEN IF IBM OR ITS AUTHORIZED SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY
  64. OF SUCH DAMAGES.  IN ADDITION, IBM WILL NOT BE LIABLE FOR ANY DAMAGES
  65. CLAIMED BY YOU BASED ON ANY THIRD-PARTY CLAIM.

  67. The above limitations of remedies also applies to any developer and/or
  68. supplier of the PROGRAM. Such developer and/or supplier is an intended
  69. beneficiary of this Section.
  70.  
  71. Some jurisdictions do not allow these limitations or exclusions, so they
  72. may not apply to you.
  73.  
  74. 4. General
  75.  
  76. You may terminate your license at any time.  IBM may terminate your license
  77. if you fail to comply with the terms and conditions of this license.  In
  78. either event, you must destroy your copy of the PROGRAM.
  79.  
  80. You agree that you have no agreement that prohibits your use of this
  81. PROGRAM.  You agree to abide by the terms and conditions of all applicable
  82. program license agreements including those related to Microsoft products.
  83.  
  84. You are responsible for payment of any taxes, including personal property
  85. taxes, resulting from this license.
  86.  
  87. Neither party may bring an action, regardless of form, more than two years
  88. after the cause of the action arose.
  89.  
  90. If you acquire the PROGRAM in the United States, this license is governed
  91. by the laws of the State of New York.  If you acquired the PROGRAM in
  92. Canada, this license is governed by the laws of the Province of Ontario.
  93. Otherwise, this license is governed by the laws of the country in which you
  94. acquired the PROGRAM.
