  1. Sundial Systems License Agreement For Desktop Software Products
  2.  
  3. Read this Agreement before installing or using the Product.  Installing
  4. the Product indicates that you accept the terms of this Agreement.  If
  5. you do not accept or agree to these terms, return the product package
  6. with all accompanying materials for a full refund.
  7.  
  8. Copyright:  The software and documentation (Product) accompanying this
  9. Agreement are copyrighted and protected by United States and
  10. international copyright laws as well as international treaty provisions.
  11. You must treat the Product like any other copyrighted material, except
  12. to the extent that this Agreement provides to the contrary.
  13.  
  14. License:  You are licensed by Sundial Systems Corporation to use the
  15. software on one computer at a time.  You may install the software on as
  16. many computers as you personally use from time-to-time.  However, you
  17. (and, if obtained for personal use, members of your immediate family)
  18. may use only one such installation at a time.  You may copy the software
  19. onto additional sets of media for backup purposes only.  You may not
  20. reverse engineer, decompile, disassemble, or make any attempt to
  21. discover the source code of the software.  All rights not expressly
  22. granted are reserved by Sundial Systems Corporation.

  24. License Number and Access Code:  You understand that the Product License
  25. Number and Access Code information (if provided) is valuable and agree
  26. to take all reasonable precautions to protect it as you would any other
  27. confidential information and not disclose it to anyone other than
  28. Sundial Systems Corporation Customer Support.  Should you make use of
  29. the License Number and Access Code on more than one computer, you agree 
  30. to take reasonable steps to insure that only one such installation is in 
  31. use at a time.  You agree to compensate Sundial Systems for lost revenue
  32. and other damages should you willfully make the License Number and 
  33. Access Code information public in any manner or willfully allow it
  34. to be in use on more than once computer at a time.
  35.  
  36. Limited Warranty:  Sundial Systems Corporation warrants that for a
  37. period of 90 days from date of receipt of the Product, the media will be
  38. free of defects and the software will perform substantially in
  39. accordance with the documentation.  Under no circumstances will Sundial
  40. Systems Corporation be liable to you or any other party, for damages,
  41. including the loss of profits, savings, or other incidental or
  42. consequential damages, stemming from your use or misuse of the program -
  43. even if Sundial Systems or its authorized representative has been
  44. advised of the possibility of any such damage.  You agree that the only
  45. remedies available to you will be replacement of defective media or
  46. refund of the purchase price of the Product.

  48. SUNDIAL SYSTEMS CORPORATION DISCLAIMS ALL OTHER WARRANTIES, EITHER
  49. EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
  50. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND
  51. NON-INFRINGEMENT, WITH RESPECT TO THE PRODUCT.

  53. Some states do not allow limitation of how long an implied warranty
  54. lasts, so the above limitation may not apply to you.  Some states do not
  55. allow exclusion or limitation of incidental or consequential damages, so
  56. the above limitation or exclusion may not apply to you.  This limited
  57. warranty gives you specific legal rights, and you may have other rights
  58. which vary from state to state.
  59.  
  60. U.S. Government Restricted Rights:  Use, duplication, or disclosure by
  61. the U.S. Government is subject to the restricted rights applicable to
  62. commercial computer software under DFARS 252.227-7013 and FAR 52.227-19.
