  1. File Hound Beta 0.2b License Agreement
  2.    
  3. GRANT OF LICENSE
  4.  
  5. Aaron R. Gaalswyk (the AUTHOR) grants you a non-exclusive, non-transferable 
  6. license to the SOFTWARE (hereinafter defined), free of charge, provided 
  7. that you adhere to the terms of this license agreement. 
  8.  
  9. The SOFTWARE is licensed, not sold.  The AUTHOR does not transfer title 
  10. to the SOFTWARE to you.  No rights are granted to you other than those listed
  11. in this license agreement.  By installing or USING (hereinafter defined) the 
  12. SOFTWARE, you signify your agreement to the terms of this license agreement.

  14.  
  15. 1. DEFINITIONS.  As used herein, the following definitions shall apply:

  17. a. "SOFTWARE" shall mean the File Hound 0.2b object code and any accompanying
  18.    files and documentation, including any files generated by the USE of the 
  19.    object code.
  20.  
  21. b. "USE" shall mean the reading into and out of memory of the SOFTWARE and
  22.    the execution of the SOFTWARE, in whole or in part.

  25. 2. LICENSE
  26.  
  27. You may:
  28.  
  29. a. USE the SOFTWARE on one or more machines at the same time.
  30.  
  31. b. USE the SOFTWARE on a network, provided that each person who USES
  32.    the SOFTWARE complies with the terms of this license agreement.
  33.  
  34. c. Make copies of the SOFTWARE or portions thereof for backup purposes.
  35.  
  36. d. Make copies of the original distribution archive or repackage the files
  37.    contained in the original distribution archive and redistribute
  38.    those copies to any other party provided that
  39.     
  40.    1. All files contained in the original distribution archive are 
  41.       redistributed intact and unaltered.
  42.      
  43.    2. Any party which receives the copied or repackaged distribution archive
  44.       complies with the terms of this license agreement, signified by
  45.       installing or using the SOFTWARE.
  46.                 
  47. You may NOT:

  49. a. Lease, rent, sublicense, or assign the SOFTWARE, or otherwise transfer
  50.    any rights to the SOFTWARE.
  51.  
  52. b. Remove any notices or labels from the SOFTWARE.
  53.  
  54. c. Reverse engineer, reverse compile, disassemble, translate, modify, create
  55.    derivative works, or otherwise alter the SOFTWARE.

  57. d. Copy or redistribute the SOFTWARE other than as listed above.

  60. 3. DISCLAIMER OF WARRANTY
  61.  
  62. a. THE SOFTWARE IS PROVIDED ON AN 'AS IS' BASIS. NO WARRANTY IS GRANTED TO 
  63.    YOU BY THE AUTHOR, EITHER EXPRESSED OR IMPLIED, INCLUDING NO IMPLIED 
  64.    WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 
  65.    THE SOFTWARE IS NOT INTENDED FOR USE IN ANY ENVIRONMENT WHICH REQUIRES 
  66.    FAIL-SAFE OPERATION.  SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF 
  67.    IMPLIED WARRANTIES, SO THE LIMITATIONS AND DISCLAMERS MAY NOT APPLY TO YOU.

  69. b. THE AUTHOR DOES NOT WARRANT THAT THE SOFTWARE IS FREE FROM CLAIMS BY ANY 
  70.    THIRD PARTY OF PATENT, TRADEMARK, COPYRIGHT, TRADE SECRET, OR ANY OTHER 
  71.    INTELLECTUAL PROPERTY INFRINGEMENT.

  73. c. THE AUTHOR IS NOT OBLIGATED TO PROVIDE UPDATES, FIXES, OR ENHANCEMENTS TO 
  74.    THE SOFTWARE.  UNDER NO CIRCUMSTANCES DOES THIS LICENSE ENTITLE YOU TO ANY 
  75.    UPDATES, FIXES, OR ENHANCEMENTS TO THE SOFTWARE.

  77. d. THE AUTHOR SHALL NOT BE HELD RESPONSIBLE OR LIABLE FOR ANY DIRECT, SPECIAL,
  78.    CONSEQUENTIAL, OR INCIDENTAL DAMAGES OR LOSS OF PROFITS OR SAVINGS RESULTING 
  79.    FROM INSTALLATION OR USE OF THE SOFTWARE, INCLUDING BUT NOT LIMITED TO 
  80.    DAMAGES TO HARDWARE AND LOSS OR DAMAGE TO RECORDS OR DATA, EVEN IF THE 
  81.    AUTHOR HAS BEEN ADVISED OF THE POSSIBILITY THEREOF.  THE AUTHOR SHALL NOT 
  82.    BE HELD RESPONSIBLE OR LIABLE FOR ANY DAMAGES CLAIMED AGAINST YOU BY A THIRD 
  83.    PARTY.

  86. 4. TITLE

  88. The SOFTWARE is owned by the AUTHOR, and is protected under United States 
  89. copyright laws and applicable treaties.  The AUTHOR reserves all rights to
  90. prosecute violation of this license in accordance with applicable law.

  93. 5. EXPIRATION OF LICENSE
  94.  
  95. License to the SOFTWARE expires on October 31, 1997.  After this date, 
  96. your license to the SOFTWARE is terminated.

  98.  
  99. 6. TERMINATION
  100.  
  101. a. You may terminate this license at your discretion, at any time.  
  102.  
  103. b. This license is automatically terminated if you fail to comply with the 
  104.    terms of this license agreement.
  105.    
  106. c. Upon termination of license, you may no longer USE the SOFTWARE.  You 
  107.    must destroy all copies of the SOFTWARE in your possession and on 
  108.    machines where you have administrative access.
