  5. This collection of symbols and icons (hereinafter the "Software") is
  6. provided to you under license. No sale has occurred.
  7.  
  8. Please read this agreement carefully. Use of any portion of this
  9. Software will acknowledgment that you have read this agreement and
  10. accept the terms of this license.

  13. 1. Copyright.
  14.     The Software, its documentation and related materials are
  15.     copyrighted, 1998, by edv-beratung wimmers and its licensors.
  16.     All rights of all parties are reserved.

  19. 2. License.
  20.     edv-beratung wimmers grants you a non-exclusive license to use
  21.     the Software and its contents in accordance with the terms of
  22.     this license. All licenses must be registered with edv-beratung
  23.     wimmers (see register in section 3 of this license)

  25.     You may use the Software on a single computer. You may also
  26.     use the Software on a second (portable or home) computer so
  27.     long as only one copy is used at a time. You may make a
  28.     single copy of the Software for backup and archival purposes
  29.     only provided that any copy must contain all proprietary
  30.     notices included in the original. If the Software comes to
  31.     you on media you own the media on which the Software is
  32.     recorded, but not the Software.  This license is not a sale
  33.     of the original or any copy of the Software.

  35.     You may never convert any part of this Software to an other format
  36.     or any other platform. Except linking to your application as
  37.     Resource (DLL or bind to EXE), and only if you purchased the
  38.     proper developer-license.

  40.     If you have purchased a:

  42.     a)  Single Desktop User License
  43.         edv-beratung wimmers grants you a non-exclusive right and license
  44.         to use the Symbols, Icons or any other artwork of this Software
  45.         to change and/or replace symbols and icons on your "Desktop".

  47.     b)  Single Freeware Developer License
  48.         edv-beratung wimmers grants you a non-exclusive right and license
  49.         to use this software as provided in section 2.a and grants you
  50.         the right and license to develop 1 (one) Freeware-Application that
  51.         implements any symbols, icons or artwork contained in this package,
  52.         as resource for your application in a 'DLL' ONLY USED BY YOUR
  53.         APPLICATION, or linked directly to the executables, except for ONE
  54.         Symbol or Icon that you can deliver in ICO-Format, used for your
  55.         executable. This license must be registered with your Name, eMail
  56.         and application-name.

  58.     c)  Single Shareware Developer License
  59.         edv-beratung wimmers grants you a non-exclusive right and license
  60.         to use this software as provided in section 2.a and grants you
  61.         the right and license to develop 1 (one) Shareware-Application that
  62.         implements any symbols, icons or artwork contained in this package,
  63.         as resource for your application in a 'DLL' ONLY USED BY YOUR
  64.         APPLICATION, or linked directly to the executables, except for ONE
  65.         Symbol or Icon that you can deliver in ICO-Format, used for your
  66.         executable. This license must be registered with your Name, eMail
  67.         and application-name.

  69.     d)  Unlimited Shareware Developer License
  70.         edv-beratung wimmers grants you a non-exclusive right and license
  71.         to use this software as provided in section 2.c. Also may you
  72.         develop any number of applications under the terms of this license.
  73.         This license must be registered with your name an eMail.

  75.     e)  Single Commercial Developer License
  76.         edv-beratung wimmers grants you a non-exclusive right and license
  77.         to use this software as provided in section 2.c. Also may you develop
  78.         1 (one) applications for commercial in-house use or environment OR
  79.         packaged as a commercial application. This license must be registered
  80.         with your Companyname, eMail and application-name.

  82.     f)  Unlimited Commercial Developer License
  83.         edv-beratung wimmers grants you a non-exclusive right and license
  84.         to use this software as provided in section 2.c. Also may you develop
  85.         any number of applications, used in a commercial in-house environment
  86.         AND/OR shipped and packaged as a commercial application, under the
  87.         terms of this license. This license must be registered with your
  88.         Companyname, eMail.

  90.     g)  Evaluation copy
  91.         If you have obtained an evaluation copy of the Software, and have
  92.         not purchased a license to the Software, 'edv-beratung wimmers'
  93.         grants you a 30-day non-exclusive license to use the Software
  94.         free of charge for the purpose of evaluating whether you wish
  95.         to purchase an ongoing license for the Software.

  97. 3. Registering the Software
  98.    Any license must be registered. Your Software will be registered
  99.    automatically, if you purchased via BMT or Compuserves Registration
  100.    Service (GO SWREG).

  102.    You will get an eMail with the license you've purchased.
  103.    This eMail is filled out with your Name and if you've purchased
  104.    a non 'Unlimited License' an Applicationname. Both, the Fax and the
  105.    eMail are signed with an encryption software. This is your license -
  106.    store it in a save place and handle it as any other legal document.

  109. 4. Copying the Software.
  110.    You may not copy or reproduce any part of the Software or related
  111.    documentation. You may not copy, lend, lease, rent, convert, publish
  112.    as web-graphics, or alter the Software in any way or remove or alter
  113.    copyright notices.

  115. 5. Use of Symbols and/or Icons
  116.    If you have a Developer License, you may modify and customize the
  117.    symbols or icons to fit your needs, incorporate them into applications,
  118.    and distribute them as part of those applications. In no case may you
  119.    distribute any of the files individually; sell, or receive any type of
  120.    consideration for the symbols or icons themselves; or offer any number
  121.    of symbols or icons as part of your own symbol library or other software
  122.    product. Application developers with registered 'Unlimited Developer
  123.    License' may, however, distribute to their clients the files needed
  124.    for their clients' application in the ordinary course of business and,
  125.    of course, charge for their services.

  127. 6. Assignment.
  128.    If you eventually sell the license to, or otherwise legally transfer,
  129.    this Software to another party, that other party must agree to all of
  130.    the terms of this license, and you may not retain any copies of the
  131.    Software, documentation and related materials. All of your rights under
  132.    this license will then cease.

  134. 7. Term.
  135.    Your rights hereunder shall continue until the earlier of
  136.  
  137.    a) your transfer of all rights to the Software as provided
  138.       in Section 6 or
  139.  
  140.    b) your failure to comply with any of the terms and conditions
  141.       of this license.
