  3. License Information

  5. Before using this package, you should carefully read the following terms
  6. and conditions. Using the package indicates your acceptance of the terms
  7. and conditions. If you do not agree to the terms and conditions, do not
  8. use this package.

  10. IBM DEVELOPER AGREEMENT FOR PRE-RELEASE OF WORKFRAME/2 VERSION 2
  11.  
  12. GRANT OF LICENSE:
  13. International Business Machines Corporation or the applicable IBM
  14. country organization (IBM) grants you a non-transferable license to use
  15. one copy of the supplied WorkFrame/2 V2 beta code (which is comprised of
  16. object code and documentation) on only one machine at any time solely for
  17. testing and development feedback within your enterprise. You may also
  18. make one copy of the WorkFrame/2 V2 beta code solely for backup purposes
  19. or archival purposes.

  21. You may not copy, modify or merge copies of the WorkFrame/2 V2 beta
  22. code, except as this agreement provides.  You may not reverse compile
  23. or reverse assemble any programs in the WorkFrame/2 V2 beta code.  You
  24. may not rent, lease, sell, sublicense, or assign or otherwise transfer
  25. the WorkFrame/2 V2 beta code.  IBM owns copyrights in the WorkFrame/2 V2
  26. beta code.

  28. TERM and TERMINATION
  29. Unless IBM notifies you of an earlier date (with 14 days notice) your
  30. license for the WorkFrame/2 V2 beta code terminates on October 8, 1993.
  31. Upon termination you agree to destroy all copies of the WorkFrame/2 V2
  32. beta code.  You may terminate your license at any time by destroying all
  33. your copies of the WorkFrame/2 V2 beta code.  IBM may terminate your
  34. license if you fail to comply with the terms and conditions of this
  35. agreement.

  37. DISCLAIMER OF WARRANTY
  38. The WorkFrame/2 V2 beta code contains pre-release code and may be
  39. modified substantially before general availability. The WorkFrame/2 V2
  40. beta code may not be at the level of performance or compatibility of
  41. generally available IBM products.

  43. The WorkFrame/2 V2 beta code is provided "AS IS" WITHOUT ANY IBM
  44. WARRANTIES OR CONDITIONS), EXPRESS OR IMPLIED WITH RESPECT TO THE
  45. WORKFRAME/2 V2 BETA CODE, INCLUDING THE IMPLIED WARRANTIES (OR
  46. CONDITIONS) OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE
  47. ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF THE WORKFRAME/2 V2 BETA
  48. CODE AND DOCUMENTATION REMAINS WITH YOU.

  50. Some jurisdictions do not allow the exclusion of implied warranties, so
  51. the above may not apply to you.

  53. IN NO EVENT WILL IBM BE LIABLE FOR ANY LOST PROFITS, LOST SAVINGS,
  54. INCIDENTAL OR INDIRECT DAMAGES OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES,
  55. EVEN IF IBM OR ITS AUTHORISED SUPPLIER HAS BEEN ADVISED OF THE
  56. POSSIBILITY OF SUCH DAMAGES. IN ADDITION, IBM WILL NOT BE LIABLE FOR ANY
  57. DAMAGES CLAIMED BY YOU BASED ON ANY THIRD PARTY CLAIM.

  59. Some jurisdictions do not allow the exclusion or limitation for
  60. consequential or incidential damages, so the above may not apply to you.

  62. If you use the WorkFrame/2 V2 beta code in the United States, the license
  63. is governed by the laws of the State of New York. If you use the
  64. WorkFrame/2 V2 beta code in Canada, this license is governed by the laws
  65. of the Province of Ontario. Otherwise, this license is governed by the
  66. laws of the country in which you use the WorkFrame/2 V2 beta code.
