  52. THE LICENSE HEREIN IS VALID ONLY FOR USERS THAT HAVE PURCHASED THE PRODUCT

  55. This is a license agreement and not an agreement for sale.  Y.A.M.  owns 
  56. all copyrights to the program - "OpenWin" henceforth the Program.  You 
  57. obtain no rights other than the license granted you by this agreement.  
  58. Title to the enclosed copy of the Program, and any copy made from it, is 
  59. retained by Y.A.M..  Y.A.M.  licenses your use of the program.  You assume 
  60. all responsibility for the selection of the program to achieve your 
  61. intended results and for the installation of, use of, and results obtained 
  62. from, the program.

  66. You may:

  68. 1. Use the program on only one machine and only one user may operate it at 
  69. any one time, unless permission to use it on more than one machine at any 
  70. one time is granted in attached Special License Information ;

  72. 2. Make a copy of the Program for backup or modification purposes only in support 
  73. of your authorized use.  However, programs marked "Copy Protected" limit copying;

  75. 3. Transfer possession of copies of the program to another party by transferring 
  76. this copy of the OpenWin Program License Agreement, the License Information, and 
  77. all other documentation, along with at least one complete, unaltered copy of the 
  78. program.  You must, at the same time, either transfer to such other party or 
  79. destroy all other copies of the program in your possession, including modified 
  80. copies or portions of the Program merged into other programs.  Such transfer of 
  81. possession terminates your license from Y.A.M..  Such other party shall be 
  82. licensed, under the terms of this agreement, upon acceptance of this agreement by 
  83. its initial use of the program.  You shall reproduce and include the copyright 
  84. notice(s) on all such copies of the Program, in whole or in part.

  87. You may not:

  89. 1. Use, copy, modify, merge, or transfer copies of the Program 
  90. except as provided in this agreement;

  92. 2. Perverse assemble or reverse compile the program, and/or

  94. 3. Sub license, rent, lease or assign the program or any copy thereof.

  97.             LIMITED WARRANTY

  99. Warranty details and limitations are described in the Statement of Limited 
  100. Warranty which is attached.  Y.A.M. provides a three-month limited warranty on the 
  101. media for all programs.  For selected programs, as indicated on the outside of 
  102. the package, a limited warranty on the program is available.  The applicable 
  103. warranty period is measured from the date of delivery to the original user as 
  104. evidenced by a Certain Programs receipt., as indicated on the outside of the 
  105. package, are not warranted and are provided "AS IS."

  107. SUCH WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, 
  108. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  109. FITNESS FOR A PARTICULAR PURPOSE.

  112. LIMITATION OF REMEDIES

  114. Y.A.M.'s entire liability and your exclusive remedy shall be as follows:

  116. 1. Y.A.M. will provide the warranty described in Y.A.M.'s statement of Limited 
  117. Warranty.  If Y.A.M.'s authorized distributor does not replace defective media or, 
  118. if applicable, make the Program operate as warranted, or replace the Program with 
  119. a functionally equivalent program, all as warranted, you may terminate your 
  120. license and your money will be refunded upon the return of all of your copies of 
  121. the Program.

  123. 2. For any claim arising out of Y.A.M.'s limited warranty, or for any other 
  124. claim whatsoever related to the subject matter of this agreement, Y.A.M.'s 
  125. liability for actual damages, regardless of the form of action, shall be 
  126. limited to the money paid to Y.A.M., its authorized dealer, or its approved 
  127. supplier for the license for the program that caused the damage, or that is 
  128. the subject matter of, or is directly related to, the cause of action.  
  129. This limitation will not apply to claims for personal injury or damages to 
  130. real or tangible personal property caused by Y.A.M.'s negligence.

  132. 3. In no event will Y.A.M. be liable for any lost profits, lost savings, or any 
  133. incidental damages or other consequential damages , even if Y.A.M., its authorized 
  134. dealer, or its approved supplier, has been advised of the possibility of such 
  135. damages, or for any claim by you based on a third party claim.

  138. GENERAL

  140. You may terminate your license at any time by destroying all copies of the 
  141. Program in your possession, or as otherwise described in this agreement.

  143. Y.A.M. may terminate your license if you fail to comply with the terms and 
  144. conditions of this agreement.  Upon such termination, you agree to destroy all 
  145. copies of the Program in your possession.  
  146. :p.
  147. Any attempt to sub-license, rent, lease or assign, or, except as expressly 
  148. provided herein, to transfer any copy of the program is void.  
  149. :p.
  150. You agree that you are responsible for payment of any taxes, including personal 
  151. property taxes, resulting from this agreement.  No action, regardless of form, 
  152. arising out of this agreement may be brought by either party more than two years 
  153. after the cause of action has arisen, except for breach of the provisions in the 
  154. section entitled "License", in which event four years shall apply.

  168. Y.A.M. Computers (1982) Ltd.  (Y.A.M.) grants the following limited warranty for this 
  169. Y.A.M. Licensed Program - OpenWin (Program), if this copy of the program is 
  170. delivered by Y.A.M., a Y.A.M. authorized dealer for this program, or any other Y.A.M. 
  171. approved supplier for this program to a user (supplier).  Such a user is referred 
  172. to herein as "original user."  A "user" shall mean a customer who acquired 
  173. possession of and is licensed to use this copy of the program for his own use, or 
  174. for use within his own business enterprise, and not for re-marketing.  Any unused 
  175. portion of the warranty period may be conveyed to another user.

  178. 1. MEDIA

  181. The Warranty Period for the media on which the program is recorded is for three 
  182. months from the date of its delivery to the original user, as evidenced by a 
  183. receipt.

  186. Y.A.M. warrants that this media will be free from defects in material and 
  187. workmanship under normal use during the warranty period.  If notified during the 
  188. warranty period that the media contains such defects, your media supplier will 
  189. replace such media.  If the media supplier is unable to deliver replacement 
  190. media, you may terminate your license and your money will be refunded upon return 
  191. of all copies of the program in your possession.

  197. The warranty period for this program is for three months from the date of its 
  198. delivery to the original user, as evidenced by a receipt.

  201. Y.A.M. warrants that this program, if unaltered, will conform to its program 
  202. specifications during the warranty period, when such program is properly used on 
  203. a machine for which it was designed.  If notified during the warranty period that 
  204. the program contain s defects such that it does not conform to its program 
  205. specifications, Y.A.M. will 1) attempt to make the program operate as warranted a) 
  206. if prior to the service expiration date, by providing a correction, or b) if 
  207. after the service expiration date, by providing any existing corrections, or 2) 
  208. replace the program with a functionally equivalent program, as determined by Y.A.M..  
  209. In the event that Y.A.M. does not provide such a remedy, you may terminate your 
  210. license and your money will be refunded upon return of all of your copies of the 
  211. program.

  214. Y.A.M. does not warrant that any other defects in the program will be corrected or 
  215. that the operation of the program will be uninterrupted.
