  33.  BEFORE OPENING THIS PACKAGE, YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND 
  34. CONDITIONS.  OPENING THIS PACKAGE INDICATES YOUR ACCEPTANCE OF THESE TERMS AND 
  35. CONDITIONS.  IF YOU DO NOT AGREE WITH THEM, YOU SHOULD PROMPTLY RETURN THE 
  36. PACKAGE UNOPENED AND YOUR MONEY WILL BE REFUNDED.

  38.  This is a license agreement and not an agreement for sale.  OpenWin Inc. owns 
  39. copyrights in the program - OpenWin.  You obtain no rights other than the 
  40. license granted you by this agreement.  Title to the enclosed copy of the 
  41. program, and any copy made from it, is retained by OpenWin Inc..  OpenWin Inc. 
  42. licenses your use of the program.  You assume all responsibility for the 
  43. selection of the program to achieve your intended results and for the 
  44. installation of, use of, and results obtained from, the program.

  46.  LICENSE

  48. You may:

  50. 1. use the program on only one machine at any one time, unless permission to 
  51. use it on more than one machine at any one time is granted in attached Special 
  52. License Information ;

  54. 2. make a copy of the Program for backup or modification purposes only in 
  55. support of your authorized use.  However, programs marked "Copy Protected" 
  56. limit copying; 
  57.  
  58. 3. transfer possession of copies of the program to another party by 
  59. transferring this copy of the OpenWin Program License Agreement, the License 
  60. Information, and all other documentation, along with at least one complete, 
  61. unaltered copy of the program.  You must, at the same time, either transfer to 
  62. such other party or destroy all other copies of the program in your possession, 
  63. including modified copies or portions of the program merged into other 
  64. programs.  Such transfer of possession terminates your license from OpenWin 
  65. Inc..  Such other party shall be licensed, under the terms of this agreement, 
  66. upon acceptance of this agreement by its initial use of the program.  You shall 
  67. reproduce and include the copyright notice(s) on all such copies of the 
  68. program, in w hole or in part. 
  69.  
  70. You shall not:  1. use, copy, modify, merge, or transfer copies of the program 
  71. except as provided in this agreement; 
  72.  
  73. 2. reverse assemble or reverse compile the program, and/or 
  74.  
  75. 3. Sub license, rent, lease or assign the program or any copy thereof. 
  76.  
  77. LIMITED WARRANTY 
  78.  
  79. Warranty details and limitations are described in the Statement of Limited 
  80. Warranty which is attached.  OpenWin Inc. provides a three-month limited 
  81. warranty on the media for all programs.  For selected programs, as indicated on 
  82. the outside of the package, a limited warranty on the program is available. 
  83. The applicable warranty period is measured from the date of delivery to the 
  84. original user as evidenced by a Certain Programs receipt., as indicated on the 
  85. outside of the package, are not warranted and are provided "A S IS." 
  86.  
  87. SUCH WARRANTIES ARE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, 
  88. INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  89. FITNESS FOR A PARTICULAR PURPOSE.

  91.  LIMITATION OF REMEDIES 
  92.  
  93. OpenWin's entire liability and your exclusive remedy shall be as follows- 
  94.  
  95. 1. OpenWin Inc. will provide the warranty described in OpenWin's statement of 
  96. Limited Warranty.  If OpenWin's authorized distributor does not replace 
  97. defective media or, if applicable, make the Program operate as warranted, or 
  98. replace the program with a functionally equivalent program, all as warranted, 
  99. you may terminate your license and your money will be refunded upon the return 
  100. of all of your copies of the program. 
  101.  
  102. 2. For any claim arising out of OpenWin's limited warranty, or for any other 
  103. claim whatsoever related to the subject matter of this agreement, OpenWin's 
  104. liability for actual damages, regardless of the form of action, shall be 
  105. limited to the greater of $5,000 or the money paid to OpenWin Inc., its 
  106. authorized dealer, or its approved supplier for the license for the program 
  107. that caused the damage, or that is the subject matter of, or is directly 
  108. related to, the cause of action.  This limitation will not apply to claims for 
  109. personal injury or damages to real or tangible personal property caused by 
  110. OpenWin's negligence. 
  111.  
  112. 3. In no event will OpenWin Inc. be liable for any lost profits, lost savings, 
  113. or any incidental damages or other consequential damages , even if OpenWin 
  114. Inc., its authorized dealer, or its approved supplier ,has been advised of the 
  115. possibility of such damages, or for any claim by you based on a third party 
  116. claim. 
  117.  
  118. GENERAL 
  119.  
  120. You may terminate your license at any time by destroying all copies of the 
  121. program in your possession, or as otherwise described in this agreement. 
  122.  
  123. OpenWin Inc. may terminate your license if you fail to comply with the terms 
  124. and conditions of this agreement.  Upon such termination, you agree to destroy 
  125. all copies of the program in your possession. 
  126.  
  127. Any attempt to sub license, rent, lease or assign, or, except as expressly 
  128. provided herein, to transfer any copy of the program is void. 
  129.  
  130. You agree that you are responsible for payment of any taxes, including personal 
  131. property taxes, resulting from this agreement.  No action, regardless of form, 
  132. arising out of this agreement may be brought by either party more than two 
  133. years after the cause of action has arisen, except for breach of the provisions 
  134. in the section entitled "License", in which event four years shall apply. 
  135.  
  136. This agreement will be construed under the law of Israel.

  141.  STATEMENT OF LIMITED WARRANTY

  143. (MEDIA AND PROGRAM) 
  144.  
  145.  OpenWin Inc. (OpenWin) grants the following limited warranty for this OpenWin 
  146. Inc. Licensed Program - OpenWin (Program), if this copy of the program is 
  147. delivered by OpenWin Inc., a OpenWin Inc. authorized dealer for this program, 
  148. or any other OpenWin Inc. approved supplier for this program to a user 
  149. (supplier).  Such a user is referred to herein as "original user."  A "user" 
  150. shall mean a customer who acquired possession of and is licensed to use this 
  151. copy of the program for his own use, or for use within his own business 
  152. enterprise, and not for re-marketing.  Any unused portion of the warranty 
  153. period may be conveyed to another user. 
  154.  
  155. 1. MEDIA 
  156.  
  157. The Warranty Period for the media on which the program is recorded is for three 
  158. months from the date of its delivery to the original user, as evidenced by a 
  159. receipt. 
  160.  
  161. OpenWin Inc. warrants that this media will be free from defects in material and 
  162. workmanship under normal use during the warranty period.  If notified during 
  163. the warranty period that the media contains such defects, your media supplier 
  164. will replace such media.  If the media supplier is unable to deliver 
  165. replacement media, you may terminate your license and your money will be 
  166. refunded upon return of all copies of the program in your possession.

  168.  2. PROGRAM 
  169.  
  170.  The warranty period for this program is for three months from the date of its 
  171. delivery to the original user, as evidenced by a receipt. 
  172.  
  173. OpenWin Inc. warrants that this program, if unaltered, will conform to its 
  174. program specifications during the warranty period, when such program is 
  175. properly used on a machine for which it was designed.  If notified during the 
  176. warranty period that the program contain s defects such that it does not 
  177. conform to its program specifications, OpenWin Inc. will 1) attempt to make the 
  178. program operate as warranted a) if prior to the service expiration date, by 
  179. providing a correction, or b) if after the service expiration date, by 
  180. providing any existing corrections, or 2) replace the program with a 
  181. functionally equivalent program, as determined by OpenWin Inc.. In the event 
  182. that OpenWin Inc. does not provide such a remedy, you may terminate your 
  183. license and your money will be refunded upon return of all of your copies of 
  184. the program.

  186. OpenWin Inc. does not warrant that any other defects in the program will be 
  187. corrected or that the operation of the program will be uninterrupted. 
  188.  
  189. This limited warranty will apply only if the program is licensed. 
  190.  
  191. THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED,

  336. This demonstration package will give you a quick look at OpenWin development

  339. In order to operate the package you should enter the OpenWin Demonstration 
  340. Package Folder from the Desktop Manager.

  342. To run the sample application select "OpenWin Demonstration Application".

  344. Follow the demonstration by pressing Continue button. To step backwards use Esc 
  345. key.
