  1. Warp Enhancer Pre-Release License Agreement

  3. PLEASE READ THIS LICENSE AGREEMENT CAREFULLY.  YOU MUST
  4. AGREE TO THE FOLLOWING TERMS AND CONDITIONS BEFORE
  5. USING WARP ENHANCER PRE-REALEASE (the "SOFTWARE").
  6. IF YOU DO NOT AGREE TO ANY OF THESE TERMS YOU ARE NOT
  7. ABLE TO USE THE SOFTWARE.

  9. 1. Ownership and License.

  11. The Software is owned by InnoTek Systemberatung and
  12. is copyrighted and licensed, not sold.  The Software
  13. consists of machine-readable instructions, audio/
  14. visual content (such as software documentation) and
  15. related licensed materials.

  17. InnoTek Systemberatung grants you free of charge a
  18. non-exclusive, non-transferable license to download
  19. the Software and install one or more copies and to use
  20. the Software for any legal purpose.  You may: 1) copy
  21. the Software for backup. You may not: 1) merge,
  22. distribute, sublicense, lease, or rent the Software
  23. except as specifically permitted by this Pre-Release
  24. License; 2) reverse assemble, reverse compile, or
  25. otherwise translate the Software except as specifically
  26. permitted by law without the possibility of contractual
  27. waiver.

  30. 2. Warranty Disclaimer and Limitation of Liability

  32. InnoTek licenses the Software to you on an "AS IS" basis,
  33. without warranty of any kind.  INNOTEK HEREBY EXPRESSLY
  34. DISCLAIMS ALL WARRANTIES OR CONDITIONS, EITHER EXPRESS OR
  35. IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
  36. WARRANTIES OR CONDITIONS OF MERCHANTABILITY AND FITNESS
  37. FOR A PARTICULAR PURPOSE.  The entire risk arising from
  38. use of the Software remains with you.

  40. INNOTEK WILL NOT BE LIABLE FOR ANY DIRECT DAMAGES OR FOR
  41. ANY SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OR FOR ANY
  42. ECONOMIC CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR
  43. SAVINGS), EVEN IF INNOTEK, OR ITS DISTRIBUTOR, HAS BEEN
  44. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  InnoTek will
  45. not be liable for the loss of, or damage to, your records
  46. or data, or any damages claimed by you based on a third
  47. party claim.

  50. 3. Termination of License

  52. This License is effective until terminated.
  53. Licensee may terminate this License at any time by
  54. destroying all copies of Software including any
  55. documentation. This License will terminate immediately
  56. without notice from InnoTek if Licensee fails to comply
  57. with any provision of this License.  Upon termination,
  58. Licensee must destroy all copies of Software.
