  1.                     License Agreement and Limited Warranty

  4. 1. Introduction.  
  5.  
  6.    This agreement explains when and how you may use the
  7.    TimeLogger software. 
  8.  
  9.    In this agreement:
  10.  
  11.    *  "TimeLogger" means the TimeLogger time tracking
  12.    software you have purchased or obtained for evaluation,
  13.    including both the program and the associated
  14.    documentation and other materials.
  15.  
  16.    *  "Partial Functionality Mode" means the functionality
  17.    of TimeLogger has been restricted in certain ways by
  18.    LCA.
  19.  
  20.    *  "Full Functionality Mode" means the full
  21.    functionality of TimeLogger has been enabled.
  22.    
  23.    *  "Registration ID" means a number you purchase from
  24.    LCA which enables the Full Functionality Mode of
  25.    TimeLogger.
  26.    
  27.    *  "we" or "us" or "LCA" means Lightning Creek
  28.    Associates.
  29.  
  30.    *  "you" means the end user of TimeLogger.
  31.  
  32. 2. Legal Agreement.  
  33.  
  34.    This is a legal agreement which allows you, the end
  35.    user, to use TimeLogger under certain terms and
  36.    conditions.  If you cannot agree to abide by the terms
  37.    of this agreement you may not use TimeLogger.
  38.  
  39. 3. Copyright.  
  40.  
  41.    TimeLogger is fully protected by copyright under US law
  42.    and international treaty provisions.

  44. 4. Use of TimeLogger. 
  45.  
  46.    You may use TimeLogger in Partial Functionality Mode on
  47.    as many computers as you like for evaluation and/or to
  48.    give feedback to LCA.
  49.    
  50.    You may use TimeLogger in Full Functionality Mode on as
  51.    many computers as you like as long as you are the only
  52.    person using TimeLogger.  Alternately, you may allow as
  53.    many other people to use TimeLogger as you like as long
  54.    as you restrict its use to only one computer.

  56.    You assume full responsibility for the selection and
  57.    use of TimeLogger to achieve your intended results.

  59. 5. Making and Distributing Copies of TimeLogger.  
  60.  
  61.    You may make copies of your TimeLogger to give to
  62.    others, as long as you include all of the files that
  63.    you originally received with your copy.  You may not
  64.    give your Registration ID to others.  When you give an
  65.    Copy of TimeLogger to another person, you agree to
  66.    inform them that their copy is to be used in accordance
  67.    with this license agreement. You agree not to sell
  68.    copies of TimeLogger or distribute them to others for
  69.    any kind of compensation or fee other than the cost of
  70.    media and shipping.

  72. 6. Registering TimeLogger.  
  73.  
  74.    You register TimeLogger by purchasing a Registration ID
  75.    number from LCA.  Entering this number into the
  76.    appropriate dialog box in the program will enable the
  77.    Full Functionality Mode.  You may then use TimeLogger
  78.    in Full Functionality Mode in accordance with the
  79.    restrictions described in paragraph 4 (Use Of
  80.    TimeLogger).  You agree not to divulge the Registration
  81.    ID to any other person.

  83. 7. LIMITED WARRANTY:  
  84.  
  85.    The following limited warranty applies to TimeLogger
  86.    running in Full Functionality Mode.  It is included
  87.    here so you understand what your warranty will be when
  88.    you purchase a Registration ID.  This warranty does NOT
  89.    apply to TimeLogger running in Partial Functionality
  90.    Mode.

  92.    Bugs and Program Errors.  We do not promise that
  93.    TimeLogger will be free of bugs or program errors.  If
  94.    you report a program error or bug to us, we will use
  95.    our best efforts to correct it.  If we issue a
  96.    maintenance release for TimeLogger which includes a
  97.    correction for an error you reported, we will send you
  98.    a copy of that maintenance release at no charge if you
  99.    request it.  We will only do this for maintenance
  100.    releases, not for new major releases or other new
  101.    versions of TimeLogger.
  102.  
  103.    Satisfaction Guarantee.  If you are dissatisfied with
  104.    any product you buy from us under this Agreement for
  105.    any reason, you may return it at any time up to 30 days
  106.    after purchase and we will give you a refund.  At this
  107.    time you forfeit your license to use TimeLogger in Full
  108.    Functionality Mode.  To disable Full Functionality
  109.    Mode, you must run the uninstall utility that comes
  110.    with the software..

  112. 8. Disclaimers and Limitations.  
  113.  
  114.    Disclaimer for Partial Functionality Mode:  You are not
  115.    paying for the use of TimeLogger in Partial
  116.    Functionality Mode.  Accordingly TimeLogger is provided
  117.    "AS-IS" and without warranty of any kind when
  118.    functioning in that mode.

  120.    Disclaimer for Full Functionality Mode:  Except for the
  121.    limited warranty stated above, we disclaim any and all
  122.    other warranties, express or implied, oral or written,
  123.    including any implied warranties of merchantability or
  124.    fitness for a particular purpose.  The limited warranty
  125.    above gives you specific legal rights, but you may have
  126.    other rights, which vary from state to state.

  128.    Limitation of Liability:  In no event shall we be
  129.    liable for any incidental, consequential, or punitive
  130.    damages whatsoever arising out of the use of TimeLogger
  131.    or your relationship with us even if we have been
  132.    informed of such possibility in advance. Some states do
  133.    not allow exclusion or limitation of liability for
  134.    incidental or consequential damages, therefore the
  135.    above limitation may not apply to you.
