License Agreement and Limited Warranty
1. Introduction.
This agreement explains when and how you may use the
TimeLogger software.
In this agreement:
* "TimeLogger" means the TimeLogger time tracking
software you have purchased or obtained for evaluation,
including both the program and the associated
documentation and other materials.
* "Partial Functionality Mode" means the functionality
of TimeLogger has been restricted in certain ways by
LCA.
* "Full Functionality Mode" means the full
functionality of TimeLogger has been enabled.
* "Registration ID" means a number you purchase from
LCA which enables the Full Functionality Mode of
TimeLogger.
* "we" or "us" or "LCA" means Lightning Creek
Associates.
* "you" means the end user of TimeLogger.
2. Legal Agreement.
This is a legal agreement which allows you, the end
user, to use TimeLogger under certain terms and
conditions. If you cannot agree to abide by the terms
of this agreement you may not use TimeLogger.
3. Copyright.
TimeLogger is fully protected by copyright under US law
and international treaty provisions.
4. Use of TimeLogger.
You may use TimeLogger in Partial Functionality Mode on
as many computers as you like for evaluation and/or to
give feedback to LCA.
You may use TimeLogger in Full Functionality Mode on as
many computers as you like as long as you are the only
person using TimeLogger. Alternately, you may allow as
many other people to use TimeLogger as you like as long
as you restrict its use to only one computer.
You assume full responsibility for the selection and
use of TimeLogger to achieve your intended results.
5. Making and Distributing Copies of TimeLogger.
You may make copies of your TimeLogger to give to
others, as long as you include all of the files that
you originally received with your copy. You may not
give your Registration ID to others. When you give an
Copy of TimeLogger to another person, you agree to
inform them that their copy is to be used in accordance
with this license agreement. You agree not to sell
copies of TimeLogger or distribute them to others for
any kind of compensation or fee other than the cost of
media and shipping.
6. Registering TimeLogger.
You register TimeLogger by purchasing a Registration ID
number from LCA. Entering this number into the
appropriate dialog box in the program will enable the
Full Functionality Mode. You may then use TimeLogger
in Full Functionality Mode in accordance with the
restrictions described in paragraph 4 (Use Of
TimeLogger). You agree not to divulge the Registration
ID to any other person.
7. LIMITED WARRANTY:
The following limited warranty applies to TimeLogger
running in Full Functionality Mode. It is included
here so you understand what your warranty will be when
you purchase a Registration ID. This warranty does NOT
apply to TimeLogger running in Partial Functionality
Mode.
Bugs and Program Errors. We do not promise that
TimeLogger will be free of bugs or program errors. If
you report a program error or bug to us, we will use
our best efforts to correct it. If we issue a
maintenance release for TimeLogger which includes a
correction for an error you reported, we will send you
a copy of that maintenance release at no charge if you
request it. We will only do this for maintenance
releases, not for new major releases or other new
versions of TimeLogger.
Satisfaction Guarantee. If you are dissatisfied with
any product you buy from us under this Agreement for
any reason, you may return it at any time up to 30 days
after purchase and we will give you a refund. At this
time you forfeit your license to use TimeLogger in Full
Functionality Mode. To disable Full Functionality
Mode, you must run the uninstall utility that comes
with the software..
8. Disclaimers and Limitations.
Disclaimer for Partial Functionality Mode: You are not
paying for the use of TimeLogger in Partial
Functionality Mode. Accordingly TimeLogger is provided
"AS-IS" and without warranty of any kind when
functioning in that mode.
Disclaimer for Full Functionality Mode: Except for the
limited warranty stated above, we disclaim any and all
other warranties, express or implied, oral or written,
including any implied warranties of merchantability or
fitness for a particular purpose. The limited warranty
above gives you specific legal rights, but you may have
other rights, which vary from state to state.
Limitation of Liability: In no event shall we be
liable for any incidental, consequential, or punitive
damages whatsoever arising out of the use of TimeLogger
or your relationship with us even if we have been
informed of such possibility in advance. Some states do
not allow exclusion or limitation of liability for
incidental or consequential damages, therefore the
above limitation may not apply to you.
