  1. !Patience v 1.00 Terms & Conditions of Use

  7. The terms contained within this document are legally binding.
  8.  
  9. "The product" is defined to be the collection of all files which may from
  10. time to time make up the !Patience release. An explicit, but not exhaustive
  11. list of files may be found in the document !Patience.Release which also forms
  12. part of this legal document.
  13.  
  14. "the author" is Paul R. Irwin
  15.  
  16. Version 1.00 of the product is "freeware". The essential, but not exhaustive,
  17. elements of "freeware" are described thus:
  18.  
  19.     i) The author retains full copyright over the product in its
  20. entirety, and over each of its constituent files.
  21.     ii) Subject to clauses (iii), (iv), (v), (vi), (vii), and (viii)
  22. below, the program may be freely distributed. Distribution occurs when the
  23. product, or any of its constituent files are dissemminated by any means, in
  24. any form, lawfully or otherwise, to another person or persons, or from one
  25. computer to another.
  26.     iii) No charge must be made for distribution ( except for a nominal
  27. fee for distribution media ).
  28.     iv) The product must be distributed as a complete package.
  29.     v) The product is distributed in its most recently released form. The
  30. author will maintain a copy of the product in its most recently released
  31. form, and that copy will be regarded as definitive for the purposes of this
  32. clause.
  33.         vi) The product may not be distributed as part of a non-free package
  34. of any kind ( including, but not limited to, magazine, hardware and software)
  35. without prior written consent from the author.
  36.         vii) If any further distribution occurs credit must be clearly given
  37. to the author.
  38.         viii) It is up to those persons to whom the product is distributed,
  39. whether lawfully or otherwise, to ensure no distribution occurs outside the
  40. terms contained within this document.
  41.         ix) The product is provided "as is", and is to be used by any person
  42. at their own risk; the author makes no express warranties, and also excludes
  43. any implied warranties, of the merchantability of this software or its
  44. fitness for any particular purpose. In no circumstances shall the author be
  45. liable for any damage, loss of profits, or any indirect or consequential loss
  46. arising out of the use of this software or inability to use this software,
  47. even if the author has been advised of the possibility of such loss. The
  48. author does not guarantee the functionality of the product, and does not
  49. guarantee to fix any reported bugs, nor does the author guarantee to make any
  50. further releases of the product in any shape of form.

  52. Additional Legal Terms Covering Sprite Files

  55. These additional terms cover the following files ( "the sprite files" ) in
  56. this version of the product.

  61.     Squash
  62.  
  63. The author retains copyright over the sprite files.
  64.  
  65. The sprite files may not be individually or jointly distributed separately
  66. from the product, nor may they be separately or jointly incorporated or
  67. utilised in any form by any other product, or package ( including, but not
  68. limited to, magazine, hardware and software ), without the express written
  69. authorisation of the author.
  70.  
  71. The individual sprite files may not be decompiled, reverse-engineered, or
  72. otherwise split into smaller files of any type.
