  1.                  LICENSE AND DISCLAIMER OF WARRANTIES

  3.       Standard Generalized Markup Language Users' Group (SGMLUG)
  4.                          SGML Parser Materials

  6.                               1. License
  7.  
  8. SGMLUG hereby grants to any user: (1) an irrevocable royalty-free,
  9. worldwide, non-exclusive license to use, execute, reproduce, display,
  10. perform and distribute copies of, and to prepare derivative works
  11. based upon these materials; and (2) the right to authorize others to
  12. do any of the foregoing.

  14.                      2. Disclaimer of Warranties
  15.  
  16. (a) The SGML Parser Materials are provided "as is" to any USER.  USER
  17. assumes responsibility for determining the suitability of the SGML
  18. Parser Materials for its use and for results obtained.  SGMLUG makes
  19. no warranty that any errors have been eliminated from the SGML Parser
  20. Materials or that they can be eliminated by USER.  SGMLUG shall not
  21. provide any support maintenance or other aid to USER or its licensees
  22. with respect to SGML Parser Materials.  SGMLUG shall not be
  23. responsible for losses of any kind resulting from use of the SGML
  24. Parser Materials including (without limitation) any liability for
  25. business expense, machine downtime, or damages caused to USER or third
  26. parties by any deficiency, defect, error, or malfunction.

  28. (b) SGMLUG DISCLAIMS ALL WARRANTIES, EXPRESSED OR IMPLIED, ARISING OUT
  29. OF OR RELATING TO THE SGML PARSER MATERIALS OR ANY USE THEREOF,
  30. INCLUDING (WITHOUT LIMITATION) ANY WARRANTY WHATSOEVER AS TO THE
  31. FITNESS FOR A PARTICULAR USE OR THE MERCHANTABILITY OF THE SGML PARSER
  32. MATERIALS.

  34. (c) In no event shall SGMLUG be liable to USER or third parties
  35. licensed by USER for any indirect, special, incidental, or
  36. consequential damages (including lost profits).
  37. (d) SGMLUG has no knowledge of any conditions that would impair its right
  38. to license the SGML Parser Materials.  Notwithstanding the foregoing,
  39. SGMLUG does not make any warranties or representations that the
  40. SGML Parser Materials are free of claims by third parties of patent,
  41. copyright infringement or the like, nor does SGMLUG assume any
  42. liability in respect of any such infringement of rights of third
  43. parties due to USER's operation under this license.
