  6. PREAMBLE
  7.  
  8.      SciTech Software has made a tremendous investment over many years in
  9.      the development of SciTech MGL. SciTech is releasing this source code
  10.      under the SciTech MGL Public License in order to give all developers
  11.      the power to enhance and extend it even further. Since SciTech MGL
  12.      compliments other SciTech products, SciTech is continuing active
  13.      development of SciTech MGL under the terms of this License.
  14.  
  15.      This public license agreement balances SciTech Software's goals and
  16.      those of the free software development community. SciTech has used
  17.      Netscape's 'Mozilla Public License' as the model for the SciTech MGL
  18.      Public License. This license agreement is identical to the Mozilla
  19.      Public License, except for the substitution of company and product
  20.      names to SciTech and SciTech MGL respectively, and the addition of
  21.      the Amendments section at the end.
  22.  
  23. 1. Definitions.
  24.  
  25.      1.1. ``Contributor'' means each entity that creates or contributes to
  26.      the creation of Modifications.
  27.  
  28.      1.2. ``Contributor Version'' means the combination of the Original
  29.      Code, prior Modifications used by a Contributor, and the Modifications
  30.      made by that particular Contributor.
  31.  
  32.      1.3. ``Covered Code'' means the Original Code or Modifications or the
  33.      combination of the Original Code and Modifications, in each case
  34.      including portions thereof.
  35.  
  36.      1.4. ``Electronic Distribution Mechanism'' means a mechanism generally
  37.      accepted in the software development community for the electronic
  38.      transfer of data.
  39.  
  40.      1.5. ``Executable'' means Covered Code in any form other than Source
  41.      Code.
  42.  
  43.      1.6. ``Initial Developer'' means the individual or entity identified as
  44.      the Initial Developer in the Source Code notice required by Exhibit A.
  45.  
  46.      1.7. ``Larger Work'' means a work which combines Covered Code or
  47.      portions thereof with code not governed by the terms of this License.
  48.  
  49.      1.8. ``License'' means this document.
  50.  
  51.      1.9. ``Modifications'' means any addition to or deletion from the
  52.      substance or structure of either the Original Code or any previous
  53.      Modifications. When Covered Code is released as a series of files, a
  54.      Modification is:

  56.           A. Any addition to or deletion from the contents of a file
  57.           containing Original Code or previous Modifications.
  58.  
  59.           B. Any new file that contains any part of the Original Code or
  60.           previous Modifications.

  62.      1.10. ``Original Code'' means Source Code of computer software code
  63.      which is described in the Source Code notice required by Exhibit A as
  64.      Original Code, and which, at the time of its release under this License
  65.      is not already Covered Code governed by this License.

  67.      1.11. ``Source Code'' means the preferred form of the Covered Code for
  68.      making modifications to it, including all modules it contains, plus any
  69.      associated interface definition files, scripts used to control
  70.      compilation and installation of an Executable, or a list of source code
  71.      differential comparisons against either the Original Code or another
  72.      well known, available Covered Code of the Contributor's choice. The
  73.      Source Code can be in a compressed or archival form, provided the
  74.      appropriate decompression or de-archiving software is widely available
  75.      for no charge.

  77.      1.12. ``You'' means an individual or a legal entity exercising rights
  78.      under, and complying with all of the terms of, this License or a future

  91.      non-exclusive license, subject to third party intellectual property

  94.           (a) to use, reproduce, modify, display, perform, sublicense and
  95.           distribute the Original Code (or portions thereof) with or without
  96.           Modifications, or as part of a Larger Work; and

  98.           (b) under patents now or hereafter owned or controlled by Initial
  99.           Developer, to make, have made, use and sell (``Utilize'') the
  100.           Original Code (or portions thereof), but solely to the extent that
  101.           any such patent is reasonably necessary to enable You to Utilize
  102.           the Original Code (or portions thereof) and not to any greater
  103.           extent that may be necessary to Utilize further Modifications or
  104.           combinations.

  106.      2.2. Contributor Grant.
  107.      Each Contributor hereby grants You a world-wide, royalty-free,
  108.      non-exclusive license, subject to third party intellectual property
  109.      claims:

  111.           (a) to use, reproduce, modify, display, perform, sublicense and
  112.           distribute the Modifications created by such Contributor (or
  113.           portions thereof) either on an unmodified basis, with other
  114.           Modifications, as Covered Code or as part of a Larger Work; and
  115.  
  116.           (b) under patents now or hereafter owned or controlled by
  117.           Contributor, to Utilize the Contributor Version (or portions
  118.           thereof), but solely to the extent that any such patent is
  119.           reasonably necessary to enable You to Utilize the Contributor
  120.           Version (or portions thereof), and not to any greater extent that
  121.           may be necessary to Utilize further Modifications or combinations.

  123. 3. Distribution Obligations.
  124.  
  125.      3.1. Application of License.
  126.      The Modifications which You create or to which You contribute are
  127.      governed by the terms of this License, including without limitation
  128.      Section 2.2. The Source Code version of Covered Code may be distributed
  129.      only under the terms of this License or a future version of this
  130.      License released under Section 6.1, and You must include a copy of this
  131.      License with every copy of the Source Code You distribute. You may not
  132.      offer or impose any terms on any Source Code version that alters or
  133.      restricts the applicable version of this License or the recipients'
  134.      rights hereunder. However, You may include an additional document
  135.      offering the additional rights described in Section 3.5.

  137.      3.2. Availability of Source Code.
  138.      Any Modification which You create or to which You contribute must be
  139.      made available in Source Code form under the terms of this License
  140.      either on the same media as an Executable version or via an accepted
  141.      Electronic Distribution Mechanism to anyone to whom you made an
  142.      Executable version available; and if made available via Electronic
  143.      Distribution Mechanism, must remain available for at least twelve (12)
  144.      months after the date it initially became available, or at least six
  145.      (6) months after a subsequent version of that particular Modification
  146.      has been made available to such recipients. You are responsible for
  147.      ensuring that the Source Code version remains available even if the

  150.      3.3. Description of Modifications.
  151.      You must cause all Covered Code to which you contribute to contain a
  152.      file documenting the changes You made to create that Covered Code and
  153.      the date of any change. You must include a prominent statement that the
  154.      Modification is derived, directly or indirectly, from Original Code
  155.      provided by the Initial Developer and including the name of the Initial
  156.      Developer in (a) the Source Code, and (b) in any notice in an
  157.      Executable version or related documentation in which You describe the
  158.      origin or ownership of the Covered Code.

  160.      3.4. Intellectual Property Matters
  161.  
  162.           (a) Third Party Claims.
  163.           If You have knowledge that a party claims an intellectual property
  164.           right in particular functionality or code (or its utilization
  165.           under this License), you must include a text file with the source
  166.           code distribution titled ``LEGAL'' which describes the claim and
  167.           the party making the claim in sufficient detail that a recipient
  168.           will know whom to contact. If you obtain such knowledge after You

  254.      Once Covered Code has been published under a particular version of the
  255.      License, You may always continue to use it under the terms of that
  256.      version. You may also choose to use such Covered Code under the terms
  257.      of any subsequent version of the License published by SciTech. No one
  258.      other than SciTech has the right to modify the terms applicable to
  259.      Covered Code created under this License.

  261.      6.3. Derivative Works.
  262.      If you create or use a modified version of this License (which you may
  263.      only do in order to apply it to code which is not already Covered Code
  264.      governed by this License), you must (a) rename Your license so that the
  265.      phrases ``SciTech'', ``SciTech MGL Public License'', ``SMPL'', or
  266.      any confusingly similar phrase do not appear anywhere in your license
  267.      and (b) otherwise make it clear that your version of the license
  268.      contains terms which differ from the SciTech MGL Public License.
  269.      (Filling in the name of the Initial Developer, Original Code or
  270.      Contributor in the notice described in Exhibit A shall not of themselves

  302.      PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES
  303.      OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF

  313. 10. U.S. GOVERNMENT END USERS.

  316.      48 C.F.R. 2.101 (Oct. 1995), consisting of ``commercial computer
  317.      software'' and ``commercial computer software documentation,'' as such
  318.      terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent with 48
  319.      C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995),

  323. 11. MISCELLANEOUS.

  325.      This License represents the complete agreement concerning subject

  341.      California, with venue lying in Butte County, California, with
  342.      the losing party responsible for costs, including without limitation,
  343.      court costs and reasonable attorneys fees and expenses. The application
  344.      of the United Nations Convention on Contracts for the International
  345.      Sale of Goods is expressly excluded. Any law or regulation which
  346.      provides that the language of a contract shall be construed against the
  347.      drafter shall not apply to this License.

  349. 12. RESPONSIBILITY FOR CLAIMS.

  351.      Except in cases where another Contributor has failed to comply with
  352.      Section 3.4, You are responsible for damages arising, directly or
  353.      indirectly, out of Your utilization of rights under this License, based
  354.      on the number of copies of Covered Code you made available, the
