  1. END-USER LICENCE AGREEMENT FOR NTM PUBLISHING SOFTWARE
  2.  
  3. --IMPORTANT-READ THIS AGREEMENT CAREFULLY:
  4. This End-User Licence Agreement (hereafter the "Agreement") is a legal
  5. agreement between you (either an individual or a single entity) and NTM
  6. Publishing Corporation for the NTM Publishing software product identified
  7. above, which includes computer software and may include associated media,
  8. printed materials, and "online" or electronic documentation ("SOFTWARE
  9. PRODUCT" or "SOFTWARE"). By installing, copying, or otherwise using the
  10. SOFTWARE PRODUCT, you agree to be bound by the terms of this AGREEMENT. If
  11. you do not agree to the terms of this Agreement, you must not install, use
  12. or copy the SOFTWARE PRODUCT. If this is the case, you must not continue
  13. the installation procedure. If the SOFTWARE PRODUCT has been bought by
  14. you, you can return it to the point of purchase.

  16. SOFTWARE PRODUCT LICENCE
  17.  
  18. The SOFTWARE PRODUCT is protected by copyright laws and international
  19. copyright treaties, as well as other intellectual property laws and
  20. treaties. The SOFTWARE PRODUCT is licenced, not sold.
  21.  
  22. 1. GRANT OF LICENCE. This Agreement grants you the following rights:
  23. * Software: You may install and use one copy of the SOFTWARE PRODUCT on
  24. your computer.
  25. * Distribution: You may not distribute copies of the SOFTWARE PRODUCT
  26. among third parties.
  27. * Back up copies: You may only store or install a copy of the SOFTWARE
  28. PRODUCT for back up and/or archiving purposes.

  30. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS. 
  31. * Limitations on Reverse Engineering, Decompilation, and Disassembly: You
  32. may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT,
  33. except and only to the extent that such activity is expressly permitted by
  34. applicable law notwithstanding this limitation.
  35. * Separation of Components: The SOFTWARE PRODUCT is licenced as a single
  36. product. Its component parts may not be separated for use on more than one
  37. computer.
  38. * Rental: You may not lend, rent or lease the SOFTWARE PRODUCT. 
  39. * Termination: Without prejudice to any other rights, NTM Publishing may
  40. terminate this Agreement if you fail to comply with the terms and
  41. conditions of this Agreement. In such event, you must destroy all copies
  42. of the SOFTWARE PRODUCT and all of its component parts.

  44. 3. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT
  45. (including but not limited to any images, photographs, animations, video,
  46. audio, music, text, and "applets" incorporated into the SOFTWARE PRODUCT),
  47. the accompanying printed materials, and any copies of the SOFTWARE PRODUCT
  48. are owned by NTM Publishing or its suppliers. The SOFTWARE PRODUCT is
  49. protected by copyright laws and international treaty provisions.
  50. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted
  51. material. You may not copy the printed materials accompanying the SOFTWARE
  52. PRODUCT.

  54. 4. NO WARRANTIES. NTM Publishing expressly disclaims any warranty for the
  55. SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related documentation is
  56. provided "as is" without warranty of any kind, either express or implied,
  57. including, without limitation, the implied warranties or merchantability,
  58. fitness for a particular purpose, or noninfringement. The entire risk
  59. arising out of use or performance of the SOFTWARE PRODUCT remains with
  60. you.

  62. 5. NO LIABILITY FOR DAMAGES. In no event shall NTM Publishing or its
  63. suppliers be liable for any damages whatsoever (including, without
  64. limitation, damages for loss of business profits, business interruption,
  65. loss of business information, or any other pecuniary loss) arising out of
  66. the use of or inability to use this NTM Publishing product, even if NTM
  67. Publishing has been advised of the possibility of such damages. Because
  68. some states/jurisdictions do not allow the exclusion or limitation of
  69. liability for consequential or incidental damages, the above limitation
  70. may not apply to you.

  73. 6. MISCELLANEOUS
  74. This Agreement is governed by Dutch law. Any disputes that may arise from
  75. this Agreement will be settled by the competent judge in Amsterdam, The
  76. Netherlands. Should you have any questions concerning this Agreement, or
